I HATE tax credits i really do.
We were in reciept of tax credits..daughter was awarded DLA and myself careres allowance. I called to tell them abbout being awarded both benefits. All done, all my awards from that point now stated a section about 'because you have a child with a disability' etc etc etc, it was only one year later i called to change an income amount............they tell me the careres allowance was not ever entered!!!!!
I appealed. no luck..tried again...no luck, i was told i had plenty enough time to see their mistake so it still stood!!
I went to my local MP who wrote to them 3 times and i was eventualy told by the tax credits people it still stood i had time to spot their mistake (htf i would like to know....i thought they would add both like i asked and teh awards stated about the disability element) and that i could not appeal against his decision.

What really pi$$es me off the most is he works for tax credits!! so i think an independant ajudicator (spelling?!?!) should be used.

One of their own has decided this.
I have fought tooth n nail and don't know what to do now, makes my blood boil.

I am furious. So much so I have made myself bankrupt over it so that the tax can now be retrieved through that system. I was told I had over paid by £3500. I had phoned up the tax credit helpline all the way through and constantly advised them of precise amounts in earnings and this is the way they treat you. Spoke to solicitor - can't take Inland revenue to court. What a crap country.

I have had a nightmare over the last couple of weeks with tax credits i apparently have been overpaid every single year since they came into effect .... the first lot they are saying was overpaid in oct 03 which is 6months after credits came into effect and 10 months after they were informed of a change of circumstances which i might add is noted on their system as every other change i have informed them about as it has happened yet apparently its not their fault and i should know this .!!!!!! also they reckon i have been overpaid nearly £4000 in 5 weeks which again i think i would have noticed but i have been to the inland revenue wrote a letter disputing this also saying that their operators are miss quoting me on the system when i phoned 2 days ago to say i am going to an appointment at the local inland rev regarding this i found out that i had been quoted as saying i accepted liability .......any other ideas of what to do , i have as i say notified them of evey change of circs as they happen .The sums they are stating run up into £10-£15,000 but they will not listen to reason i have requested a detailed breakdown of all overpayments from '03 -'07 i dont hold out much hope though:eek:
    bitter...lol
  • Hi

I am thanking god we're not alone in this whole sorry mess.

We have had a demand dating back to 2003! for about £2500. Now considering my husband has each year given them the EXACT figure off his P60 we are scratching our heads wondering just how they have worked out this overpayment.

I have had a nightmare trying to get this sorted out and am no nearer knowing what is going on with it. Every change of circumstance has been told to CTC and when myself and my husband split up for about 6/7 months they were informed of this as well. The "overpayment" from that period of time has as far as im aware been written off as we had proof that we had split up (*hubby was in military at the time and he moved back into barracks so he had the bill on his wage slip)
What worries me now is that we are coming up for another change in circumstance as the job hubby is in at the moment which is full time is closing down and he can only find part time work (at least it's a job tho). I cannot work due to health probs and in their wisdom as I'm only 40% disabled I don't qualify for any kind of disability benefit.
With 3 kids to feed and clothe and rent to pay i just don't know what we're going to do if i'm honest.

We are still getting letters on a very sporadic basis some tell us we no longer owe them anything, yet a few days later we get the demands through again

    it's an absolute farce!!!!!!!

I have only ever claimed once and they claimed after it was an overpayment and we have to pay it back. As we did not need to claim for the year after, we dod not complete the forms. This it turns out as our error, because they sent a bil for £2100 overpayment. (only claimed for part of one year). They then told us we had left it too late to complete the following years and that we had missed the deadline for appeal. SO I have paid off £1000 and they have taken me to court for the rest. This system sucks. Never claimed anything in my life and dont think I ever will again. Very disillusioned.!!!!!!!

i have just had my second appeal against £8890 turned down with the same crap excuse of they think i should have been aware i was receiving too much money. i have had an islington peoples rights officer involved when she is not on annual or sick leave but it has made little difference, three years on i am no nearer to sorting it out!!! but it doesnt look good, god knows how they will expect me to pay it back. i am since on disability benefits but my husband is working so dreading how much they will expect in monthly repayments??

thought i would just update by saying 16 months on am no further along. keep sending complaint forms and keep being told as you have given no new info our decision is the same. they are still saying i did not inform them of my marriage until a year later, which of course is not true. £4500 of this money was paid into account in one month and when i rang to query it they said i was owed it from previous years and now they are saying i was paid too much that whole year as i was still being paid as single. i cant keep going on ignoring this and hoping itwill go away and filling forms is getting me nowhere. so i have now written to them to say that although i have received this money it was their error and not mine but that i am not denying i received the money. i have said i will not be responsible for paying the whole 100% but expecxt them to come up with a figure that would be agreeable to us both and over a suitable amount of time. so now have to see what they make of that!!!!!

Just wanted to shine a little light in the Tax Credits tunnel.......... I was told I owed DWP just over £6,000, I appealed and it has been reduced to just over £700, so keep on battling, it can be done!

    DWP?

Tax Credits are administered by HMRC.
