    Companies DO NOT HAVE TO OFFER COMPENSATION

    Which would have been offering advice and answering the OP's question, instead we have yet another thread full of spiteful mickey taking.

    Poppycat. Don't accept those three eggs, they are probably out of date. :rotfl:

    And to the rest of the tom.senex sympathisers, most people who post on MSE with a "Compensation Culture" mentallity get the same response and deservedly so. There is too much of this American culture creeping into our lives.
    The chocolate may have been on the shelf out of date but no-one forced anyone to buy it let alone eat it.

    I don't see any reason to ridicule a person for simply asking a question. There is no reason to be mean and rude, it is completely unnecessary and unjustified.
    If someone reaches out for advice and help from fellow moneysavers, they should be treated with respect, whether or not you find their question silly.
    Treat others as you want to be treated yourself. People seem to think that just because they are sitting behind a monitor and will never meet the people who they are talking to they can be as rude and obnoxious as they want. I doubt in real life they act as cruely, otherwise they would permanently have black eyes.

    And if I wanted compensation for eating chocolate that hadn't affected me adversely, then I would accept all the criticism I got.
    I suspect that if it was your little corner shop that inadvertantly sold the chocolate and was facing a claim for compensation from tom.senex your thoughts might be different, unless of course you also subscribe to this mad compensation culture.

    I wasn't questioning the merits of Tom-senex's question, and have at no time suggested that he be given compensation, so I think you are misguided.
    What I was commenting on was the way he was treated. I see no reason for cruel and mean posts, even if I thought someone had asked a stupid question, I wouldn't find that it warranted a malicious response.
  • If I had bought chocolate from Whittards ( a shop I consider reputable) and found the chocolate was 3 months out of date then I would expect a gesture of goodwill ( and think I would have got one too!!!) 3 months is a long time passed the best before date - unless I was rummaging in the reduced section at my local 99p shop I would not feel I needed to check the dates on chocolate to see if it should have been eaten 3 months previously. I do not agree with compensation culture - but a gesture of goodwill to ensure that the shop keeps my custom and assures me it was a one off ?? Yes !
    I have had brain surgery - sorry if I am a little confused sometimes ;)

    Just to let you know ems, this is an OPEN FORUM, therefore people will give their own opinions on what they seem right or wrong.

    I myself was commentating on the fact that the OP is saying that they SHOULD have been given compensation. Why?

  • It's sad to see people being so nasty to a newbie who had a genuine question about his rights, free speach is all very well but the rules clearly state 'be nice to people'. What's more I don't think there has been much of an answer. For those out there who don't already know everything...

    My understanding is that when you buy something from a shop the act of exchanging money for goods forms a binding contract.
    That contract is in this case for you to have some chocolate (which is in good condtion and free from minor defects).

    In most cases this means that the vendor has an obligation to replace substandard chocolate as the contract is 'for you to have some chocolate'.

    Once you have had reasonable time to inspect the goods you are not intitled to your money back (this may be a very short time according to some test cases). As your agreement was for you to have some chocolate (not some money).

    The only time you wold be entitled to compensation is if you could demonastrte that they had done you harm (eg made you ill, given you flashbaks about mouldy chocolate which prevented you doing your job...)
    AND that they were neglegent in doing so.

    Still trading standards is another matter and I would have thought it was good buisness practise to leave a genuinely disgruntaled customer satisfied (otherwise they tend to go one chat rooms and tell anyone who'll listen what poor service they got)

    A letter to head office may get a more diplomatic reponse, then again, it may not.
