this is not about morality - this is about a legally binding agreement which you signed, and yet which you now propose to break - by refusing to pay rent that your landlord is entitled to.
if he tried to get you out part way thru your tenancy you'd have cause to be angry.
an agreement is a two-way thing and depends on each party doing the right thing. Clearly you dont know what that is ...................

I think I have discovered, since my short tenancy on these boards, that there are nice landlords on here who respect that a home is a massive part of a families life. And there are the ones who justify their meanness by crying "it's a business" and treat their tenants as cattle.

As you plan to stay as long as possible, if you refuse to leave at the end of the notice period the LL will need a court order to evict you. The cost of doing this and the rent unpaid could be reclaimed from you via the small claims court (if the LL deems it worthwhile)
Check that the section 21 notice has been issued correctly, (although if the name was spelt wrong why didn't you reseal the envelope and pop it back in the post with return to sender on it - not known at this address. this would have bought you another month at least) and get yourself some proper advice.
I cannot see them chasing me for money, they will just be glad to get their house back.

Hey Daz.... Ive got no 'real' advice mate, but I just wanted to let you know that you're not alone. We got served with an eviction order on the 8th December. Had it hanging over us all over Christmas and it was bloody miserable. But the upshot is that we've found an absolutely beautiful new home, a thousand times nicer than this one, and we move on the 1st Feb.

This is a gamble you will have to decide whether you take. X months lost rent whilst they go through eviction proceedings, plus costs for evicting you could come to a tidy sum. Now if its some large corporation that have bought the petrol station and land they might write this off as nothing in the big scheme of things, or they might think its worth chasing (after all they will have plenty of staff and its only a question of a couple of hours here and there for one person.)0 -

But when tenants take the p&ss like you are doing, i do tend to harden up, if you had moved out early and stopped paying rent, i might have some sympathy for your actions, but, to deliberately stay there and not pay rent is theft - whether criminal or civil - stop acting like a child, accept the legality of what your landlord has done and put some energy into finding a new home for you and your family instead of whinging on here0 -

As I said earlier, I consider somebodys housing needs to be a little more than words on a contract. You don't.
Legally, you are right. Morally, I consider myself to be right. You do not just chuck a family out on to the street. It is an awful thing to do.
I would hardly say I was whinging, I just asked for some advice about a particular aspect of my problem. You decided to start judging me.
I have accepted the legalities of the situation, any fool reading this thread can see that ( I thought ).

You're not being chucked out on the street. This is just emotive language. You are being given notice to find somewhere else to live. And you are not judging the Landlord? I know you don't like it but ... this is their property. Morals don't enter in to it. If they act legally, then that's all they need to do.
