and harassing and threatening him does what exactly?

unless uve sent it to the police or summat, your just harassing a person therough email. u clearly have too much time on ur hands...

The o/ps responses verge on blackmail.

I would raise a paypal dispute, 'item not as described', send it back by a recorded method, get your money back, THEN leave negative feedback saying these are fakes - far more effective in reducing his sales capacity than the 'jonny-big-balls' approach.
  • Agree with the above, refunds the right way to go but the "head in the vice" stuff is BS and not the right way forward for anyone,

I'm happy to refund any of my buyers on ebay/play/amazon or anywhere else if they aren't satisfied, but if anyone sent me a post like the OP they'd get naff all as long as i could help it.

There's being reasonably forceful and theres being an @rsehole.

The guy is deliberately selling fake items on ebay. I give him about as much credence as I give !!!!!! on the bottom of my shoe. I agree with the above if it were an honest mistake, the OP makes it clear that it wasn't.

Some people need to get a set of knackers, methinks

So you are Jonny-big-balls then?

The police will care little - apart from anything your average cop wont even know what you mean when you say its badged as 16GB, but only accepts 4GB of data - ebay will care less, as long as they've got their fees, and you've greatly lessened your chances of getting your money back.

My way, you'd have got your money back, AND you would have warned everyone else by leaving an appropriately worded neg.

But if huffing and puffing on here makes you feel better...
  • I bought a few on ebay 16 and 32GB all of them are fake, now I have problem to get refund - look at my user ID sakura_x1. most of sellers want to return their product back by signed for but pay pal will not refund my postage cost.
At the moment is a lot of fake pen drives, I reported to ebay but they do nothing.
Please help me how to get the money back

    Hi Folks,

Check this out. I bought a 16gb pen drive on E-Bay the other night. It turned out that it was a fake pen drive. It was actually a 4gb disguised as a 16gb. When you look at the properties of the pen drive in windows explorer it even reads 16gb but it will only ever hold 4gb.

    What did I do?

    MESSAGE 1 TO SCAMMER

    Hi Pillbox,
This pen drive doesn't work. Every time I copy files onto it they get corrupted. I've tried it on a few machines and every time it crashes. Seems to be when I go over 4gb. The machine shows 16gb in properties though. I've just discovered that this is a FAKE.

I will give you 2 options and you have 1 day to respond.

Option 1. You send me a working 16gb PEN Drive

Option 2. I follow this course of action having negated you with SCAM ALERT FAKE PEN DRIVE:

    - If you refuse to reply or refuse to provide a full refund, I will proceed to file it under eBay's Standard Purchase Protection program. I will get my money back from eBay and this will also result in full termination of your ebay account. PAYPAL included.

Your choice. You have until midnight Wednesday.

RESPONSE TO MESSAGE 1 FROM SCAMMER
Dear mikeHi im sorry to hear the drive is dysfunctional, return with the packaging and I will issue a refund. My address is:

(I've taken this out for confidentiality reasons)

If you could include the item number. And your eBay name in a short note I can from there trace your payment.

    Regards Jason

    MESSAGE 2 TO SCAMMER

    Hi Jason,
I'm sorry to also hear that the pen drive is dysfunctional. I'm not sending this pen drive back to you. I'm keeping it as evidence that you are trading illegal fake pen drives. I am giving you 1 day to give me a refund. Otherwise I will report you to your local police, EBay and Paypal authorities. If I get my refund within 1 day I will close the matter. If not then I will proceed as stated. Count yourself lucky that I am offering to close the matter on refund.
    Regards

    Mike

AAAAggggghhhhh!!!! Time to ramp up the pressure. What I needed to do was put the scammers head very close to the cooker and turn it up to gas mark nine.

MESSAGE 3 TO SCAMMER – LAST CHANCE WARNING

    Hi Jason,
Just in case you 'forgot' about my refund for the 16gb fake pen drive you sold me. Here is the address and phone number of the Lancashire Constabulary in Spring Gardens, Accrington, Lancashire BB5 2BJ
    Tel: 0845 1253545.

Here is your name and address:
(I've taken this out for confidentiality reasons)

In your selling history I see you have been trading quite a few of these fake 16gb pen drives.

I see the pen drive you sold me is pictured on this ebay fake pen drive warning page:
    http://reviews.ebay.com/BEWARE-of-FAKE-1GB-2GB-4GB-8GB-USB-Flash-Drives-on-eBay_W0QQugidZ10000000001456613

What you have committed is fraud which is a criminal offence. Criminal offence means fines and jail. Plus your ebay sale history will really shoot you in the foot. You have created enough evidence to attract enough attention.

NOW. Do I have to push this or do I get my refund? This is your last chance before I open a Pandora’s box on you.

    Best Regards

    Mike

Its unbelievable how some people act, if i was the OP i would be embarassed to post that.

Totally inapropriate bullying from the very first messege, and the fact that your bragging about how badly you treaded the seller lowers my opinion of you even more.

There are many legit traders who may accidentally sell goods like this, and alot of show offs like you who just dont know how to use a PC.

There are many explanations as to why it didnt work, and even if it was fake you should have sent it back for a refund rather than blackmailing the seller.

This is just one of many examples as to why its so hard for genuine friendly people to use ebay.

    I disagree.

If the item was fake then the seller should never receive it back otherwise they will only sell it on to someone else as they don't care who's money they are taking.
