Agree fully with you, M Thomson. It is irresponsible to get yourselves into such a situation in the first place, and then cry 'foul' at the banks and reclaim any such charges.

With respect, I think that your view is rather uncharitable and, if I may say so, quite misguided.
I hope you are not unexpectedly made redundant, or that your employer never makes a mistake with your wages.

So DChurch, were you made redundant or has your employer made a mistake with your wages? If so you should have said originally because all your posts on this subject make you look like you are just moaning about charges which you have incurred which have been your fault.

It makes no difference! Either way, banks penalty charges are not enforcable by law.

I am sorry but it always makes me laugh when people come out with that. I understand that people sometimes have money difficulties or something like the loss of a loved one etc. These people should be treated with sympathy by the bank, but people who moan about charges when it is them who caused themselves to get in that position do not have a leg to stand on. They signed a peice of paper saying that they agree to terms and conditions of the account.

Well I would expect most bank (Halifax) employees to have a similar opinion to yours - goes with the territory!

Well, I would defend my company's terms and conditions too.

What makes you think I work for them? Also, I thought agreeing to charges and terms and conditions applied to all banks???!!?

1.As a bank employee, you are naturally going to be towing the company line.

2.Agreeing to the terms and conditions makes no difference according to the Unfair Terms in Consumer Contracts Regulations 1999.

I agree totally. That is exactly what happened to me. I am now 1400 o/drawn thanks to Abbey charges.
The first time the account went overdrawn it was not my fault (employer didn't pay correct wages) and my account, thanks to the charges that were then applied never recovered.

    I have also posted this:
[Due to charges] I was 200 down, plus the fact that my employer had screwed up again, which quickly caused a spiral. Did the bank want to know? - not in the slightest.

    and this:
at a time when my (now defunct) employer had messed around with my wage payments

So, to imply that I hadn't mentioned it is incorrect.
I can understand you being upset with the charges if you are in genuine financial difficulty but you are obviously not.

Also, I still don't know how you have come to the conclusion that I am not in financial difficulty. Could you please elaborate?

It is also irrelevent how my account incurred these charges. The fact remains that they are unfair, and breach the Unfair Terms in Consumer Contracts act of 1999. Black and white.
They signed a peice of paper saying that they agree to terms and conditions of the account.

Hence we have laws to protect us agains unfair terms in these conditions.

I'm glad it makes you laugh though when people quote the law.
