  • Sorry but it is hardly a confusing situation is it?

Something arrives that isn't yours, you send it back. You don't use it for 3 months and then complain cos they want it back?

How is that confusing? Fairly straight forward if you ask me

Or at least phone them to arrange a pick up and if they didnt collect it then it was there problem.

Unfortunately now it seems the Op has used the sofa making it impossible for the company to sell on. If the OP has used it then surely they need it so maybe its worth coming to some agreement with the company over price?

    Well said.

    You'd think so wouldn't you?

Does the OP still have the money that was refunded for the damaged sofa?

The op-er is just a bit confused as to where he stands here, I think an awful lot of people are being really quick to jump down his/her throat.

The main question of worry for him/her seemed to be the fact that while the sofa was in the house/flat it has been used and s/he is concerned about getting into trouble over the usage.

A lot of other posts have seen people getting told that if it was delivered to them without them ordering it then they can keep it, I think someone mentioned it one this- people come here to find out where they stand, and are getting confused and bullied here as well as by the companies they come to escape- I personally don't think that this is the point of the board.

Jackie finds him/herself in a confusing situation and doesn't know where to stand, lets just try and hjelp figure it out together.

Er, no! Jackie knows that the sofa needs to be returned, but they have admitted that they want to keep but doesn't want to pay for it, hence people "jumping down throat" because it's wrong to keep it.

The solution is simple. Keep it and pay for it (perhaps negotiate a discount??), or arrange for the return.

Just a thought, perhaps the OP isn't English, and hence the terrible grammar/punctuation! In that case, apologies for mocking your efforts... spelling in a 2nd or 3rd language isn't easy at first!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Does that make any sense to anyone?!

Yes, despite the OP's poor grammar/syntax, I think any intelligent person could understand it without the benefit of the patronising and sarcastic translation which was later posted.

Some people had a poor education or don't have English as their language - it doesn't make them deserving of the derision and mockery you so enjoy dishing out.

Why don't you quit your aggressive and bullying tone and start giving people a chance? Most of your posts on this thread have been downright rude, and haven't been at all constructive.

At least mine gave accurate advice! I think that is a lot more constructive than giving someone factually incorrect information!

The Unsolicited Goods Act does not apply where a genuine mistake was made.

Errrm, where in that link does it qualify your statement that "The Unsolicited Goods Act does not apply where a genuine mistake was made" ?

If you keep the sofa you are depriving the legal owner to their property, this could be construed as theft??????

I gave a link to a brief summary of the Act rather than the full content because reading statute can be rather complex. However, if you take the time to read the Act, you will find that you are wrong, and every other post on this thread is correct.

  • Didn't the OP's friend sign for it? if so then i don't think that classes as being unsolicited goods?
