    i dont take anythink of any1 unless thay give it to me and thay did i never told them to send me another 1 out i waited 6 weeks for them to send my money back to me and thay had time to sort it out am not a scumbag you know just some 1 who as not got a lot of money

    not having much money isn't a reason to keep it!!

    and they didn't GIVE it to you. it was probably a computer error which printed the wrong address on the delivery form.

    Now just phone them up, and arrange for them to come and collect the sofa!! Stop trying to claim something that's not yours to claim.

    If you've had the refund from your first one, and like this one, then just offer to pay for it! If you wanted to buy a sofa and could afford to, surely you should still have the money saved up somewhere?

  • I think what the OP is trying to say is that they bought a sofa in October but returned it and got a full refund. Unfortunately, the company made a mistake and sent out a replacement which obviously they shouldn't have done.

    That fact doesn't give you the right to keep the sofa unless you offer to pay for it. This is not the same as unsolicited goods so the unsolicited goods act does not apply. You seem to have been quite happy to accept the sofa as long as the company hadn't noticed and now you are worried about getting taken to court. Well that's what tends to happen when you are dishonest.

    Just trying to work this out fully Jackie (I can be a bit dense at times :P )
    Can you just confirm the following is true:

    You ordered a sofa from this company, they delivered it but it was faulty and you returned it for a refund.
    Your refund was processed and you received it. But they have ALSO sent you a replacement sofa (chances are a mistake was made somewhere)#

    Is this right?

    If this is the case then you should have phoned when you received it to clear up any confusion- but shoulda woulda coulda never helps anybody.

    Just arrange for a collection as soon as possible- you do not have the right to keep the sofa as you have not paid for it and a mistake was made in you receiving it.

    So say the bank accidently gives you £10,00 do you keep it cos they "gave it to you"???

    I don't have much money either, but i wouldn't keep something that i knew wasn't mine.

    no i have not spoke to them the first 1 i had was broke thay sent a man out who agreed it was broke said the shop would get back to me thay never so i went to them to get my money back the man who came out must have gone back orderd a new 1 but the shop havent told no 1 i dont want another 1 so thay still sent it this what i think any way

    You took delivery of this sofa, but had already received a refund for another sofa from the same company?

    Have you got 2 sofas now then?

    If you have, then I think I understand, but if you only have the one 'free' sofa, then why?? Surely you would have already have bought or ordered another sofa once you received your refund?

    If you only have the one, then it's obvious you were out to keep it and not pay for it....since back in October?!
