  • Glad to hear that, although it was a hard day, you were taken seriously and got some answers / help / proposals.

Its really good that you are getting some help with your DS at last. It will be hard to let go even for a short time, but you have your OH and DD to think of too.
Does this diagnosis affect anything like DLA?
Maybe now you will get some support re: the housing. It is really important that there is some stability in Ryans life once all the medical professionals get their act together. You don't want a situation where everthing seems to be under control and then your housing situation disrupts it.

    Hi BM,

You've been quiet this weekend, is everything ok? Do you have a date for court yet?

    Hi MoT, Hi everyone,

Yes, sorry, I had nothing to report so thought I would be better served trying to sort my stock out so I've just been working really hard as I want to get the majority into storage this weekend, hubby has been working extra too so having to do that around him being here - we just want to save as much money as we can at the moment.

Well, nothing to update really. Council came yesterday and I can't even see why they bothered, I filled in a form that was exactly the same as the one I filled out years ago when DS was born and we had to update ourselves on the list, it told them who was here, how many rooms we had, etc... they were not interested in seeing the house, garden or the damage I had told them Ryan did which stopped us renting private (found another hole in the wall at the bottom of the stairs from where I gave him a time out on Sunday *sigh*). The lady told me she looked at my notes and that her son was autistic and that I should apply for DLA and also to have him statmented (which I knew but was more concerned at this moment with packing and getting somewhere to live) but I also told her I could not see the point in having him statmented if we did not even know where we was going to be living. She just kind of shrugged and said I could change the school afterwards. So we are nowhere nearer and nowhere further back and I don't know why she came round in all honesty. So that is that. Apparently there is a shortage of housing (which I did already know) so there is nowhere to put us but I thought maybe if they had my details now if somewhere came up in the court process at least they could consider us. Anyways, so that was that.

On another note, I spoke to a family friend yesterday and she told me that my mother had told her before Xmas that she was selling the house. And the reason mum gave: that she [mum] had an agreement with me to sell the house so we could get a council house instead!! Well, I was spitting fire for most the day yesterday when I heard that and told her exactly what was happening and what would happen to us and what mum had done to us. I am really, really annoyed at my mother as if someone told the council then we'd be kicked off the list altogether. I am still livid about it because I would not have been able to do a thing about it because of her actions and that would have left us all homeless. Sister spoke to (OK, it's my sister, she interogated) my mum again and she won't give a valid reason other than she cannot afford the house anymore - that is is. So, no-one is stil any more the wiser but everyone thinks it is to do with this woman xx that she has started hanging around with.

You know, I don't care that she is selling the house but we have offered to leave on a number of occassions in the past when we was financially able to and she begged us to stay here and keep the house a home rather than it run down to a shell as she did not want to live there, she told us it would be ours for as long as we needed it as she never had any intentions to sell. I feel like I have been made a mug of, that she has realised house prices are going to start going down and that she is getting shot of it while it is a good price. And as for us, she doesn't really give a monkeys what happens to us and whether we have somewhere to go. I feel really hurt and angry still, I can;t shake it off when I think about it and I just want to be able to have somewhere to go so I can stick 2 fingers up and be done with it all. I would not mind if it was just us but with the kids to consider makes it all the more harder to deal with. Maybe I've too much time on my hands these days, LOL!!

And that is about it really to be honest. I had a look around on the net last night and we could be in here for anything up to 3 months more. I just want to get it over and done with. opefully they will get the forms filled in and sent off for Monday as the order runs out over the weekend. The difference is that my sister (the older sister, nt the younger one) is now involved and she and my brother want us out (always have done) so I am sure they are rubbing their hands with glee at putting us 'on the streets' and the sooner the better. This whole thing is just dragging on and I am tired of having to keep the place spotless and sniping at the kids if they make a mess (as they do) just in case someone calls up and wants to come that minute for a viewing.

So that is all, no more news really. I read it takes about 2 weeks for the court date to come through and also that all I have to do is fill the form in and send it back and neither I or my Landlord (my mother) actually have to attend court unless we want to fight it. Apparently you can ask the court via the form to consider you for 'hardship' on the form and so I was going to ask for 28 days as it is usually 14 days until eviction date. I did think that if at least I attended the court that I would have the form to take to the council, I guess that it is time to get some help. I think that deep down I thought that it might not come to the court action and was trying to be so positive that the council was going to help us, but as the time goes on I know it is inevitable and because I know it is going to be a few months the reality has not really set in - we can't afford a solicitor and hubby earns too much for legal aid so I have to find the people offering free advice. I can't get the the morning CAB sessions around here because of Ryan going to school, the times clash as they only offer mornings so I'll have to look further afield into the ones in town - which i don;t usually go to because of Ryan. I have the buggy if I need it though.

So no news really. Thanks for thinking of me, I was going to update this morning once the kids were at school, just finishing all my paperwork relating to the business and packing it all, sorting out the returns people have sent back and still not finished the dreaded VAT return but I have another month to finalise this - but I feel like I am winning now.

You really should do this, in emergency housing terms it will show that you and your family have special needs. Lots of people claim that their children have special needs but are not statemented so the evidence is not taken so seriously. The lady is right about schools, with a statement you will go to the top of the list for schools, so if you find that the council houses you in a different area you will have a much higher chance of getting into the most appropriate school.

The resposne from the council seems standard, until you are at the point of being turfed out they will do nothing. MoT had the same only in the days before eviction did the council provide anything. I'm afraid this is the road you have to go down.

  • Had been thinking of you over the weekend, as you've not been on for a while. Have you any clear idea how long the process will take, sorry if you've already said, but I can't find it. Once you have a court date, are you assuming your mother will be granted possession, and then you will get a definite date?

sorry can't be more constructive, can't imagine what you are going through. Just keep on going however you can.

I agree the reason they insist is so gneuine special needs kids get priority and chancers don't if all it took was to "say" your child had special needs every tom !!!!!! and chav would be doing it. If you want it to be accounted for you have to play by the rules and help the council when they try to account for this factor. They are trying to protect the needs of genuine special kids by introducing these rules.

Thanks Silvercar & BB, I'll have a look on this then and speak to the school about the statement - they seem to be very good in trying to get him sorted as well so I will speak to them and if no joy will go to LEA. I was reading up this a couple of weeks back to be honest, it takes 6 months to get the statement so this is why I felt that it was neither here nor there to apply for it now.

Everything seems a blur of confusion as everything is being thrown at me at once. It seems we would only have a max of 3 months here and, if after that, they put us the other side of the county there will be no way they'll be able to go to the same school, so it just seemed that it was started something that inevitably would mean having to start all over again if we moved as we have to nae a school on the statement, does that make sense? On another thread I post on one lady had started the statment process and wanted to move their child to a different school but they told her she would have to see the process out from start to finish and only when she had been awared the statement could she then change the schools. So if I had to change halfway though, it would have been a waste of 3 months.

Oh, just to add though BB, he has already been put on an IEP (Individual Learning Plan) and given 1:1 by the school. They had said this was taken away as he had got better but the last couple of weeks have been an upheavel with getting him in and I noticed she has been back in there again. This is why I thought he already had the special education care he needed. The council have the copy of the IEP ith my application to show he has the 'needs' to warrant 1:1 with a TA because of his behaviour, this is why everything is just so confusing for me. It wasn't like I had just said it to get points, he already has special help at school and I have paperwork to show this as it was felt he needed it as they could not take their eyes off him. This is why I was confused as I thought he already had the statement, it was only a few weeks back that I realised a statement was something completely different.

Hi GS, No clear idea, I looked around on the internet last night as I just want some indication of how long this might take - I hate not knowing - and they indicated 14 days to get a date for a hearing, 6-8 weeks until the given court date, and then the judge gives 14 days to get out (more if hardship is taking into consideration - I was going to ask for 28 days). Thanks for the thoughts, they are appreciated, I did not think there was anything worth posting apart from the angry thoughts about my mother!!

Oooh, also, remember I said he has been awarded 15 points, apparently this is very good as people usually get 5 or 10 medical points, hardly ever do they get more than 10 so we was seen as a higher priority and so was awared 15 (out of 50)points!!
