Annual leave and Bank Holidays

I work part time - 20 hours a week.

My contract says this - You will receive 22 days paid holiday in each calendar year (calculated on a pro rata
basis by reference to a full-time entitlement of 22 days not inclusive of the usual Bank
Holidays).

Can someone tell me what this means please? Particularly the part where it says not inclusive of the usual Bank Holidays.

I think it would mean your holiday entitlement is based on a full-time employee getting 22 days a year, and because you work part time you'll receive a pro-rata amount.

The "not inclusive of the usual Bank Holidays" bit means those 22 days don't include bank holidays. Whether you actually get bank holidays off (or get time off in lieu if you work them) will depend on what the rest of your contract says and your employer's holiday policy.

Someone with more knowledge of employment contracts will hopefully be along soon, but that's how I'd read that wording.

I've just looked further on in my contact and it says - In addition to your annual leave, you will also be granted the benefit of paid Bank Holidays per holiday
year. These Bank Holidays will be scheduled according to the prevailing national or regional holidays
observed in your work location.

Assuming the standard full time is 5 days days a week, then the 22 days of leave means if you work say 5 days at 4 hours a day, you'd get 22 days, simple. But if you say worked 8 hours Mon-Tue and 4 hours Weds then you'd need 2 days leave to book a Mon or Tues off and 1 day for Weds. If you work other hours you may need fractional days, usually leave is done in hours for part timers instead of having to deal with fractional days.

For bank hols the usual fair way to do them is to allocate bank holiday hours in the same way, otherwise someone who works a long day on a Monday would end up with more time off than someone who doesn't work Mondays (as most bank hols are on Mondays). It could also mean someone who doesn't work Mondays wouldn't get the legally required amount of leave (28 days). I'd ask for clarification on bank hols as it doesn't appear clear. (unless you just work 4 hours a day Mon-Fri in which case you'll get what's fair anyway).

All bank holidays are taken off my entitlement as I work Monday Wednesday and Friday.

So i started off this year with 128 hours - out of this 80 have been taken off for Bank holidays. Which leaves me 48 hours.

A colleague who doesn't work Mondays gets them added on.

I don't understand 😕

And from what I read, it doesn't state that.

I have no idea how the 128 is worked out. The 80 is 10 x 8 hours (Monday working

hours) I'm assuming as 10 bank holidays this financial year.

I have contacted my employers and they say it is correct.

There are 8 bank holidays in England ,

9 in Scotland , plus an extra one in Scotland for 2026 for the World Cup if your employer granted it.

You will have X number of hours for paid holidays and Y number of hours for bank holidays.

HR should be able to advise of each allocation.
