So I just lost a case for a private ANPR PCN and not sure what went wrong

    I have been reckless as of late because of wrongly assuming that nothing will come back to bite me

    I will not repeat these mistakes and thank you and everyone else for their guidance on this matter

    I do have other PCNs to address but I’ll do it with proper guidance.

    The best place to start would be the newbies thread but it has become such a minefield over the years that I don’t even know where to begin and where to end lol

    thank you! Yes, only one of them is in my name for a ticket that was issued around 2 years ago - everything else is in my mother’s name

    since my mother doesn’t have the knowledge nor a deep understanding of what’s happening, she also lacks trust in my abilities because she had seen that I lost the case with this ticket

    And it was rightly pointed out that if the debt exceeds £600 from the same parking company, she could be in deep trouble so I am still weighing my options

    As you know, it costs them £100 and by this stage amounts to throwing good money after bad.

    And as you know, county court bailiffs have no incentive, visit once and don't even try. An elderly debtor will cause them to back right off.

    I remember one case where the debtor immediately offered to pay up and the response was "Oh. We don't normally get people paying. I'll have to look in the van for the paperwork."

    But this CCJ doesn't need paying because the case is concluded and under £600.

    It's only if a particular claim exceeds £600 that (if the Defendant lost and then still refused to pay what the court ordered for THAT claim alone) there could be HCEOs arriving.

    If you have other PCNs with ParkingEye they don't affect this concluded claim at all and can't be later 'totted up' to include this one.

    And ParkingEye usually use DCB Legal. Like I said earlier, you were unlucky this one was filed in-house by PEye because had it been via DCB Legal it would never have reached a hearing.

    For future reference, ParkingEye NtKs are NEVER fully PoFA compliant. The judge erred when he/she said it was. It was the defendants job to point this out to the judge.

    ParkingEye NtKs never comply with PoFA 9(2)(e)(i) as there is no invitation to the Keeper to pay the charge. This has been won in court. Whilst not a binding decision, it is still persuasive if you can point the judge to it.
