Letter of claim

Hi all, i need some advice.

I received a penalty charge notice from Smart parking almost 3 years ago in June 23. I moved house in Dec 2023. This week, in April 2026 i received a letter of claim from Dcb Legal demanding i pay £170. This was for parking for 19 mins, at the Cat & Fiddle pub in Macclesfield, while i checked if the place was open, as no one was around. A man came out from the pub, & recommended we move, as it was possible i could get a ticket. However if i did, just to ignore it.

I returned to the car to tell my wife it was closed. Then looked at the map as unclear where we were, & left the premises immediately.

Please can anyone help about what i can do next, many thanks.

Plan A in the NEWBIE sticky (which everyone is recommended to read) is to complain to the landowner/retailer or pub/restaurant owner. Have you tried that?

Definitely Not a Penalty just a private parking company invoice PCN from Smart Parking

Email the LoC response template from the 2nd post in the newbies sticky thread in announcements near the top of the forum to the info@ email address for DCB Legal. ( if DCB LEGAL sent you the LoC. )

Then , apart from plan A, wait for a Money Claim N1SDT pack from the CNBC in Northampton using MCOL to arrive in the post in due course

Yes i telephoned the pub, & spoke to a man called (censored) after receiving the Pcn from Smart parking & another letter from Debt Recovery Plus. He requested the evidence, which i sent 2 photos of the letters.

Afterwards i never heard from him, or the pub. I thought the matter was over, until this week.

    I

It's important you use the LBC response, if only to confirm the address to use for the claim form. Which is EXACTLY what you want.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

I have emailed DCBL using the LBC template, & received an automatic response today. Thanks for the help so far, & await with interest the next stage.
