Check if they paid the hearing fee
If they submitted the WS late, as is typical recently, bring it up at the very start of the hearing as a preliminary matter, to ask the judge to strike it out

It won't be struck out.
You need to raise their very late WS as a preliminary matter at the start. Make it easy for the judge to dismiss the claim in 5 mins flat.
