Euro Car Parks claim via DCB Legal
Hi Everyone
I would appreciate some advice regarding a parking fine from Europarks in Bolton.
The alleged offence was February 2025 and I have had a Final reminder on 16th Jan and a letter of claim sent 22nd Jan this year.
The parking amchine wqas very unclear and I thought I had paid, this appeal got rejected. It seems like they make the paking machine delibrately difficult to use so this happens,
They want £170 from me which is ridiculous.
I am having trouble finding the land owner but if they are sending a letter of claim then I assume it is too late for this?
I would appreciate any help or advice with this.
It seems they have proceeded way too fast between a final reminder and a letter of claim so something has to be wrong here.

Who sent the Letter of Claim ? DCB Legal ? Does it give you 30 days notice. ?
It's never too late to complain about it to the landowner or managing agents or business

The letter of claim was sent by DCB Legal and it gave a 30 day notice.

Then Email the LoC template response as seen in the second post in the newbies sticky thread in announcements near the top of the forum by coupon mad , using the info@ address for DCB Legal

Are you saying you never got a PCN in the post or a reminder last March?
If so, that's likely to be due to the keeper forgetting to update your address on the V5C. Check the logbook if you got no PCN or letters last year.
You must reply using the usual template LBC reply. Same as all the other LBC cases.
I'm 100% on your side and you will NEVER have to pay this invoice, but a year to get to LBC stage isn't fast!

Ok so I did the AOS on MCOL and am drafting a defence. I plan to use the template provided.
For section 3 I would appreciate your input, I was planning to write:
The terms and conditions were not legible due to the poor lighting in the car park and the fact I was there at night time.
An attempt was made to pay and the machine asked if I would like a receipt but did not take the payment.
It has been a year since the alleged offence so it is not possible to accurately collate evidence that is representative of the time.
No proof of a machine in working order or adequate signage has been provided by the claimant.
The way in which your machine works is deliberately misleading and designed to result in errors

My mistake, here is the edit:

No offence was committed, alleged or otherwise

Pretty moot as they'll discontinue, but I would just cut it down to something much more brief and definitive, such as:
"The defendant used the payment machine on site and paid the correct amount of money for the correct amount of parking time. The machine accepted payment and issued a receipt. It is denied any terms and conditions were breached."
