Horizon Parking Notice

I've received a PCN from the above for "Failure to Validate for the Duration of Stay". The duration time being stated as "Duration: 02:16:41". I've all ready tried to appeal to Horizon Parking using the standard template from the newbies section and not stating who the driver was. However they have rejected this and advise me the next step is to appeal to POPLA. Although I wasn't the driver at the time of this PCN. I'm aware that the Tesco signs at this car parking are miss-leading and have caught me out before. As it states if you spend £5 in tescos you are allowed 3 hrs free parking. But this isn't fully correct as I once spend over this £5 amount on Tobacco and they would not issue me with a parking voucher. I was advised in store that it didn't cover the parking £5 requirement for a voucher. The sign in the car park doesn';t state anything about the £5 excluding tobacco purchases. Surely based on this, they cannot inforce this PCN with signs so missleading and I was wondering if I should use this within my popla appeal. I assume the PCN being so recent that it is POFA co

If you've read the NEWBIES thread, please tell us if your NTK is POFA worded or not? Compare the NTK pictures. It's easy to tell.

A general note: it's a good idea to take photos of NTKs and other communications.
(I know it's after the event in this case, but folks may read this thread.)2 -
The signage is the parking contract not what some halfwit tells you at the tobacco kiosk, the driver should have asked for the manager, and you should be trying plan A now.But to be fair the signage actually states "In a Hurry Validate on line" then gives a web address or was the receipt also binned like you did the NTK thinking nothing will happen?2

There is no fine!Why would you pay?You can't assume it was not POFA compliant though you can claim it at POPLA let them do the work, not that their decision matters.What have you done about plan A which you will know about from the advice on here?2
