I assume from your comment you think an email answers everything.
FACT Emails have a habit of not arriving for various reasons - SPAM FILTERS dispose of many.
A Letter sent by Post *signed for* is proof and accepted by a court. Claiming you did not get the email  is viewed as an excuse..

So once again, what purpose would claiming he had not received the e-mail serve? He’s not thinking of doing so - particularly as he did receive it. But even if he was, since such a claim would serve no purpose, why would he need to prove it?

I still have no idea why you think the OP needs to write - by email or snail mail - to anyone...

What do you think will happen if he doesn't?

The problem with signed for is that the receiving end can refuse to sign/accept it

First class and proof of postage is all you need (since that’s what they will rely on if you state you received no letter from them)

Section 7 of the Interpretation Act  1978, which the police would rely on, applies only to letters "authorised or required" by an Act of Parliament.

The OP can not rely on it, since the letter he would send is not so authorised or required.

True - but isn’t first class (with proof of posting) assumed to have been delivered in 2 (?3) working days unless otherwise proved ?

Gone a bit off track though
  • I was caught on the 11th Oct on the M1 temp average camera by South Yorks, and when offer the "Motorway Awareness Course" on Oct26th, I booked and paid for it for the 8th Jan.

Just this morning I got an email to say the course had been withdrawn by SYP, and no info other than contact 101.
After a bit of digging, and contacting the number on the contact page of "www. safetycamera. org" the lovely lady said the ticket was showing as "cancelled, with no further action", and that a letter was sent out to me a few days ago.
Not sure if the letter will say why it was cancelled, not that i'm complaining, just curious, but will see when I get the letter.

Assumed by whom? The courts go by the law, not assumptions.

I think you have the wrong end of the stick.
The OP has received an email stating that their course has been withdrawn, without further explanation.

They don't actually need to do anything, except await a letter telling them what happens now.
They already have all the proof they need that they accepted the offer of a course and it was withdrawn.

The possibilities are that the whole thing is cancelled, they will be re-offered the fixed penalty, or they will receive Court papers.

It seems likely from other posts on this thread and around social media that it will be cancelled. (But that isn't a given until they get official notification)

Emailing or 'phoning asking for clarification is reasonable, a letter recorded or otherwise asking for clarification is pointless.

I want to go back to The Olden Days, when every single thing that I can think of was better.....

(except air quality and Medical Science ;))
  • I had a speeding ticket cancelled like this last year. Did some off-the-record digging with a PC pal and it turned out they'd been using a camera with an out of date calibration certificate. While that doesn't necessarily invalidate the speeding records, they took the decision to just cancel every ticket from that camera over a 3 week period.
