I would advise that you emphasise to them that it's a s75 claim and not a chargeback.
Have already made a claim with credit card provider but don't know whether they are treating that as a Section 75 or a Chargeback.  Should I phone them to check?
TBH. Would guess at a chargeback 1st, While they say they have proof of delivery is a slam dunk rejection. Given retailers location they may not contest & would be most unlikely to go via UK court to claim.
Only issue would be over 3 months ago, although any contact within 120 days could bring it back in time.
If that fails then the process should be to look at S75.
So what did you provide to your CC?

Sure you must know what sort of claim you made with the card provider? Chargeback and s75 are two entirely different processes together with different rights and consequences.

Just spoken to them and they tell me it is being handled as a Section 75 Chargeback.

Well, that's about the least helpful comment the CC staff could give and indicates that whoever said that also did not understand the difference.  "Chargeback" is one process (voluntary code of practice) and "S75" is another process (legal obligation).

To be fair, the term 'chargeback' (or perhaps 'charge back' here) isn't necessarily always being used in the strict defined term sense, so is likely to be an amplification of 'section 75' when used conversationally like that, but yes, those familiar with both terms should be clear when seeking to distinguish between them.
