Parking Eye PCN - Gale St

The driver entered the car park, found a space and parked. The driver was taking their minor daughter to an urgent optician's appointment.

The car park is 30 mins stay or if visiting the hairdresser or dentist then you can input your details to have a two hour stay.

The PCN was received in the post on 14 November

I have read the newbies forum and searched Parking Eye but this car park isn't mentioned that I can see and the stores are not listed in the complaint post.

Also the example complaint was posted on Pepipoo which is now obsolete.

I have tried unsuccessfully to search for the landowner.

Should I still try to complain?

    Looks like the driver failed to register the vehicle at reception, so for registered patrons only, plus overstated the 30 minutes allowed  ( according to your story   )

    Where is this terminal and in which reception   ?

    We need to see pictures of the signage on that private property too, because they should tell visitors where they should register their VRM details 

    I presume that this car park is at the back of those properties but the GSV pictures are 4 years old,  no signage 

    Definitely complain to that reception if the drivers a legitimate patron

    Thanks for the reply. I will try to get a picture of the signage, but it said that only the hairdressers and the dentists had a terminal

    Then as the appointment was at an Opticians,  the driver should not have parked there

    The pcn is for not being a patron of those 2 businesses and not registering at one of them 

    Signage is crucial here

    Plan A is not going to work

    The sign says it's 30 mins but patrons can have 2 hours if they use the terminals at one of those businesses

    But the driver overstayed , by 14 minutes and didn't register,  plus wasn't a patron of those 2 businesses

    You can certainly try it, you know the circumstances and area , I don't 

    But had you been a genuine customer or patron of those 2 businesses,  then you would have a strong case for dismissal of the pcn,  possibly due to not being asked to register 

    As a non patron, I cannot see a valid complaint point 

    IMHO,  the pcn was correctly issued,  based on the paperwork above and information so far,  breach of the parking contract,  subject to us seeing pictures of the signage,  especially the rules for parking,  are they clear, was there adequate signage etc 

    Why do you believe that you have any grounds for a complaint or an appeal  ?  Something tangible,  or irrefutable   ?

    I don't necessarily believe that I do and that's why I was posting. The newbie thread suggests that these should not be paid and be prepared to be taken to court as it will be defended successfully. Is that plan B then?

    That is plan D , D for Defend,  as Defendant 

    But do look for good legal dispute reasons, like signage,  no landowner authority etc, if you are going down the legal route 

    Complaining is the customer route, not the legal route 

    But understand if you are building your house on sand or rock

    Was the opticians on site or off site?

    Does the opticians have a keypad and offer parking, on their website?

    Could be that PEye are not up to date with all the businesses there? Complaint to the actual landowner/agent who runs the site, if so.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
