  • Thanks for the advice. I will give both the landowners AND POPLA a whirl. Hopefully the landowner's actually do something about it and cancel this.
    Otherwise I will wait for this claim form
  • Out of curiosity, (because this has never happened to me before), what would happen if parkingeye take more than 28 days to respond to my appeal? They have yet to send me a POPLA code and I was wondering if my case becomes void if they take longer.

    Seems odd, normally a POPLA Code is given in the appeal rejection letter.

  • The landowners finally came back with this:

    Dear ..........

    Thank you for your email.

    The signs state that if you do not have a parking permit you will receive a parking charge.

    There are no visitor spaces and all the bays are privately owned by individual residents.

    If you wish to challenge the parking fine you will need to speak to parking eye directly, details of how to do this are on the letter.

    This is unacceptable, you say there are signs yet when we arrived on the site I saw none whatsoever. Clearly your definition of what a sign is, is way off.
    I would like to speak to your manager regarding this issue, as I have very clearly voiced my complaint and you have barely acknowledged any of my points.
    If this is how you would present your business, I will be forced to take this up with the Ombudsman. 
  • Thanks for the advice, I will try Gary Moore but the email address that replied was Carters Surveyors unfortunately, Wavensmere has stayed silent. 
    Nevertheless I will see if I can email him directly. But there is a chance that Wavensmere has already passed off their completed properties to this Carters Surveyors company and are no longer responsible.
    No harm in trying.

    Bear in mind that it's just an invoice.

    You can send Dexie an invoice if you like. He'll just ignore it, so why is your invoice any different?
  • This is strange.... PE have sent this letter instead of giving me a POPLA code. This isn't the usual code of conduct I received in the past. Do they longer give out POPLA codes or do I just ignore this?
    My appeal to them was on 07/11.

    Dear Sir / Madam,
    Thank you for your correspondence in relation to the Parking Charge incurred on 30
    October 2025 at 13:30, at Fox House, Derby car park.
    We are writing to advise you that your recent appeal has been referred for further
    information.
    You have stated that you were not the driver of the vehicle at the date and time of the
    breach of the terms and conditions of the car park, but you have not indicated who was.
    You have already been notified that under section 9(2)(b) of schedule 4 of the Protection
    of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this parking
    charge in full. As we do not know the driver’s name or current postal address, if you were
    not the driver at the time, you should tell us the full name and the current postal
    address of the driver.
    You are warned that if, after 29 days from the Date of Issue, the parking charge has not
    been paid in full and we do not know both the name and current address of the driver, we
    have the right to recover any unpaid part of the parking charge from you, the registered
    keeper. This warning is given to you under paragraph 9(2)(f) of schedule 4 of the
    Protection of Freedoms Act 2012 and is subject to our complying with the applicable
    conditions under schedule 4 of that Act.
    Please note, if you have made or wish to make an appeal on behalf of the driver, and you
    do not provide the full name and current postal address of the driver, Parkingeye will be
    obliged to deal with the representations made in your name.
    Parkingeye have placed this charge on hold for 28 days to enable you to provide the
    evidence requested. If this information is not provided within 28 days, the appeal may well
    be rejected and a POPLA code provided.
