A common reason for different rates of pay for the same work can be how easy or difficult it was to attract suitable applicants at different times. If, for example, a local competitor has closed down there may have been a number of suitable people looking for work. At another time a firm may have to offer over the odds to attract a suitable person.

But, apart from a handful of unlawful reasons, they can pay who they like what they like!

The OP agreed to a 35 hour per week contract and is paid for that.  The other drivers have 38 hour contracts, which are not relevant to the OP.

The actual numbers are broadly irrelevant; the fact they are doing (or are contracted for) more hours hence are paid more is the relevant point.

Yes well i just find it unfair but judging by the comments it is what it is.

Unfortunately fairness or unfairness counts for nothing in employment, lawfulness is what counts

So they are getting paid more because they work 3 hours more, but, are you all on the same hourly rate, or are you on a lesser rate?

Oh, and wouuld you be happy to work an extra 3 hours?

So i have been at my current job 19 months i am a hgv driver along with 2 others we all get paid salary and it’s a job and knock set up so you do your deliveries and collections and you go home once completed. I found out a couple of months ago that back my colleagues get paid 47 hours per week and i get paid 44 hours per week i find this unfair as we all do exactly same job and they’re getting paid 3 hours more per week and at £15.26ph it definitely adds up over the year. Have i got an argument against this? I have mentioned it numerous times to management and it gets ignored. The other thing is i put a holiday day in on Thursday night on the works app for a Friday in 2 weeks time then the manager was ringing my phone off yesterday morning at 7.30am more or less saying i can’t have that day off as another driver is off that day. It’s starting to bother me working here tbh what would others do. It seems a take take take job but they’re happy for you to have Fridays off on holiday when works quiet and they ask you.

There are several things in there. First the hours, you are not being treated unfairly, you are just on different contracts.

Second, are you Class 1 or Class 2? From what I know that would be low for Class 2 and incredibly low for Class 1, so maybe better looking elsewhere regardless.

Three, it is not unreasonable to not let you book the same time off as another driver if there are only three on total and if you could already see the other driver was off then it would make sense they were annoyed. However if you had no visibility they the other driver was off then it makes no sense for the manager to be annoyed. Ringing you at 07:30 is unreasonable unless you are already on shift at that point, though I am not exactly sure what you mean by "ringing my phone off".

Overall I would say it seems obvious you do not like working there, so I would recommend you look for another job. There is still a national shortage of HGV drivers and I think you would likely be better paid elsewhere, although you would likely have to work a full day rather than finish early. So you need to work out which you prefer when viewed holistically.
