Hi Justin,I am a bit confused as to why you have mentioned Megan in your email, as her notice period ended 3 days after the notice to driver was issued and placed on the windscreen of the vehicle.
The single code of practice does state that customers will get 28 days to appeal, however we have until December 2026 to get everything compliant during the transition period. Please note we will allow an appeal to be submitted online.
Please note failing to name a driver only means that we will pursue you as the keeper under the protection of freedoms act 2012.
We will support your complaint to the landowner, as they have no issues with the way we operate the car park.
The charge is a template with the crucial information inserted, like the reason the charge was issued. If the notice had been read correctly you would have seen that the charge was issued as you were parked in a bay which is reserved for a permit holder. Attached are images taken by the officer at the time of the contravention which show an orange permit holders only sign (different colour to our standard yellow signage) and also a sign which states permit holders only.
A parking session was purchased using PayByPhone so the templated section within your email about the pay and display machine is irrelevant as a payment being made is not disputed but the bay you parked in.



So what do I do now please?

So they say that they will consider the appeal, but have stated that the signs are adequate and that the vehicle was parked in a permit only bay, which is why the pcn was issued, nothing to do with poor signage or non payment
They certainly wont cancel the pcn, no matter what you do or dont do
They will sue you if the invoice remains unpaid, they do in house litigation, no lawyers are involved
Looks like Megan has left the building, like Elvis
What is your take on the situation knowing these details ? Can you plead your case in court ?
Lastly, do not use SIP car parks in future, I wouldn't and don't1 -

The only thing I can say is that it's a bit sneaky that this was a small car park with 1 particular bay, which was permit only but i doubt that will hold up in court...
I have no problem paying for the parking (which i did) so regardless whether it was SIP or not, genuinely didn't see that stupid sign but I will avoid in future anyway because of this, at the end of the day it was my mistake.
So its either court or pay the £100 ?0 -
