Defence review requested following Claim Form - Was delivering meal to resident at assisted living

    Ah this is good news! This happens A LOT and it means the CNBC have to unpick it and reinstate the defence. However they are appalling at admin, so we recommend you also email a complaint immediately to HMCTS. They will put a bomb under the CNBC,

    We received a letter during last three days (while we were away) dated 10 Dec. with a County Court Judment for £296.22 against my wife. She has been given 30 days to pay the full judgment.

    There is no reply to the email that my wife sent. Just to recap, following acknowledgement she received no N180 form. When I called CNBC they asked me to email them back and I followed their exact instructions.

    Will be grateful for any further advice.

    Do not pay, you are expecting HMCTS to unwind the errors at the CNBC,  or the CNBC complaint to succeed

    We received two emails. First one from CNBC:  Subject: Fwd: Fw: UNPROCESSED DEFENCE: DEFENCE - Claim No.: xxxxxxxx, MCOL customer number: MC00xxxxxxxx

     

    Good morning,

    Thank you for your claim response.

     

    I’m returning it as a Judgment (CCJ) has already been entered against you. 

     

    What to do now 

    If you dispute the debt and want to remove the CCJ from your credit record, please fill in an N244 Court Application Form completing sections 1,2,3,10 and 11: In Section 3 you should ask for ‘Judgment to be Set Aside’ and give reasons why you don’t agree with it. Please note, an application to set the Judgment aside is not automatically granted and the outcome of it is at the discretion of a Deputy District Judge.

     

    Where to find application 

    You can download the N244 from www.gov.uk   

    Post three copies or email it to Applications.CNBC@justice.gov.uk

     

    Fees

    You should send your cheque or postal order (made payable to HMCTS) together with your N244 to St Katharine’s House 21 – 27 St Katharine’s Street Northampton NN1 2LH. Credit/debit card payment can be made by calling our Helpdesk number Mon - Fri between 9am and 3:15pm. 

    Help with Fees 

    Log into www.gov.uk/get-help-with-court-fees

    You will be given a Help with Fees, ‘HwF’ reference number which you need to clearly note on your application form.

    Having Investigated 

    I'm sorry despite sending your defence on time and even providing proof, you still received a judgment against you. I understand how frustrating this must be. You mentioned that CNBC returned your defence on 8 December stating it was out of time, even though you had evidence it was submitted within the deadline. This isn't the level of service we aim to provide, and I appreciate you bringing this to our attention.

     

    Why you didn't get a Directions Questionnaire
    You mentioned you never received a Directions Questionnaire (N180).  This is only sent once a defence is logged, with your claim, judgment was entered as your defence hadn't been logged on to the case management system. I understand how frustrating this must be for you.

    I can see we returned your second submission on the 15 December, due to the large volume of post and emails we receive, we've been unable to trace them.

    Getting the judgment removed

    To avoid any further delays in processing your case, please could you provide duplicate copies of your defence by emailing to CaseProgression.CNBC@justice.gov.uk.

    In the subject line please include: OPTIC REF: xxxxxxx duplicate documents provided. This will ensure that once received your case is prioritised.
