yes they are preparing legal action against the rent charges ower company for their involvement in the unlawful call and breach of several laws including gdpr. i intend to get them to court for this including the female accomplice who called me.
plus they will do the due diligence research to ensure is the right company to pay and plus they will ask the ICO to step in by investigating their internal practice in handling sensitive data.
you might all think this is a costly unnecessary course of action for 200 queeds but i believe that money especially if you can afford it must be used to avoid being considered a fool.
i will update you all don't worry. i am curious myself to find out what is going to happen0 -

Based on the bits of information you've posted here on what you think they've done, what you are asking the law firm to do will cost more than 200 queeds.
Can you list specifically the laws you are alleging they broke, and, what evidence you have?

I'm just catching up with this thread and I do kind of sympathise with the OP's suspicions about this Management Company. Writing a cheque to pay off any Rent Charge monies owed only works to clear that debt if it's paid to the correct company. I'd abandon the legal action about phone calls via NatWest and concentrate on ascertaining who now owns the rent charge; it doesn't seem unreasonable to ask for proof that this new company has a genuine right to those charges. Having Directors in common with the original defunct company doesn't sound enough to show this, or am I getting distracted? If I were worried that previous directors were sending out bills to collect Rent Charge monies from c100 houses but that there was nothing to show they had a right to collect this money, then that's what I'd maybe ask a solicitor to help me ascertain. We were served with a bill for > £4k by the director of our Management Company (freehold house on a new estate) and we got our solicitor to check it over before we paid. I'm glad we did because the invoice was from the director as an individual and not on behalf of the management company and although the invoice was for maintenance of the estate and legal advice, our solicitor pushed back that the legal advice had been sought as a private individual rather than as a director acting for the management company and therefore couldn't be passed on to the shareholders of the management co. We pushed back and the invoice was withdrawn.Sorry for the rambling post, the point I'm trying to make is that there is no point paying the invoice (however it's delivered) unless and until you know for certain that it would discharge any outstanding estate rent charge. It doesn't seem unreasonable to ask the invoice sender to prove that they are entitled to act for the new management company and to collect the rent charge, if this info isn't apparent via the HMLR deeds. It may still be a valid invoice, even if the methods of contact seem a little dodgy. If that is the case OP will still have to pay.4

appreciate your comment. my actions are a legitimate response to the method they used to get unlawfully my personal data and to make sure they are the right people.
i repeat if they knew my number why not calling me directly explaining stuff instead of making me suspicious of a scam. i said that earlier... things could have possibly gone smoothly but they decided to impersonate a bank which triggered my response.
i cannot believe how many people would have just blindly paid after being cold called by an impersonator of a bank.
these companies rely on the fact many people are broke and would not even dare to take them to court if necessary.0 -
Scammers do not give addresses as they want to remain anonymous. They do not want police arriving at their door.3

yep. glad they did not ask me bitcoin 🧑💻
anyway the letter they sent self incriminate them and they will have my lawyer at their door0 -
TCMT, could you post the section in your deeds that refers to this 'rent charge', please?
Is it pure 'ground rent', or is it also 'estate management/maintenance' or whatevs? Does it state what the monies are for - what the estate gets in return for these payments?
And does it state the name of the company with contact details?
(Bty, I see no reason to not include their name in this, as it won't reveal who you are, and there is no legal reason why you should 'hide' them.)
What does Companies House say about this?
Did you say that the Land Registry has updated deeds to show the transfer to this currently existing co from a previous - similarly titled - company?
Have you tried a Google for all the versions of this company - see if there's any dodgy practices or history?0 -
yes all done but here is not the rent charge in discussion. is how this company acted the issue that i want my solicitor to investigate. i will post once i know something new.0
