Car purchased in last five months from dealer - gearbox faulty

I have had enough of this car. The last four months have been so stressful. I have already paid out money to Nissan who were as much help as a chocolate teapot and to get the gearbox diagnosed. As well as lack of car and the extra costs of transport. Facing another £3000 bill on top of the £6395 I paid for the crappy thing. I just want to drive it through the car sales garage window!0

We have been on holiday this week (with a rental car) so haven't progressed with the gearbox repair. The car needs an MOT by the 3rd Oct so I had it MOTd today and it failed on suspension arm ball joint dust covers and track rod end ball joint dust covers. They also noticed the rear back box joint is excessively corroded and will fail soon so the car will need a new back box and middle box imminently. The garage has quoted £1200 as a rough estimate of repair for these issues and will send me a proper quote on Monday. I drove it back home but can now no longer use the vehicle until the suspension arms and track rod ends are replaced. I told the technician I purchased the car in March for £6395 and he was shocked at the state of the underside of it for that amount of money. He also said the suspension arm covers have been ineffective for a long time. This is yet another sting in the tail of what is my worst ever purchase. My wife will now have to hire a car for the foreseeable future so she can get to her job in the NHS. We have clearly been sold a dud car and you leave us no alternative but to get a third party involved.

You could point out that you now have a defunct, unroadworthy car with repairs totaling almost it's value after less than 6 months. Ask the garage to up their contribution to £2000 otherwise you'll have no option than to go via the courts as you can't afford to repair the can and rather spend the money on legal costs.
I honestly think you have a good chance of getting a "contribution". Just get keep what your claiming for reasonable.
If the inspection goes in your favour strongly, then you could try and claim for the full autobox repair.
The MOT I think, whilst still adds to your case of the car being well below the expected quality for the price paid, is more wear and tear. The MOT history does suggests occured more recently.
A nissan over 10 years is going to have a fair amount of corrosion though so taper expectations. Keep us updated on progress and good luck.0 -
The MoT failures are nothing to do with the gearbox and should be kept separate. I’m afraid MoT failures are an expected cost of motoring. Expect nothing back.If you’re not prepared to write the car off, then I think you should accept the £1,000 contribution, without prejudice and get the car fixed.
