UKCPS - 7 fines for the building I live in because the landlord never gave me a permit

Thank you. As I stated in my post, it was "friendly" advice I was given, not legal advice. I haven't gone to the team as of yet for their legal advice.Gr1pr said:
There are people in the firm who do, so you should expect better advice from them as regards litigation etc, they usually have to do stints in different departments due to the paralegal training contractsgreycats2025 said:
I do, however I do not work in litigation.Umkomaas said:If you have a legal career, surely you understand the circumstances under which a CCJ can have an affect? How old are the seven parking charges?
The parking charges span from over June and July but were appealed within the time limit.
Plus there's google search
But the newbies sticky thread in announcements is specially written for newbies like yourself
Just stick to the basics, not conjecture, not paranoia about CCJs ( widely misunderstood by the thousands of newbies who come here )
FYI paralegal work and training contracts are different. Paralegals will work in one department until/if they get a training contract, and it is at that point that they will do their seats in different departments.1 -
Unfortunately the tenancy agreement is a standard one from OpenRent that only covers very basic provisions. There's absolutely no reference to a parking permit or the car park at all. In retrospect, this is something I should have queried at the time, but as I'm sure you can imagine I didn't expect to have this problem!prowla said:The advice from the legal firm should at a minimum have been to check your tenancy agreement to see what it says and what you signed up to.0 -
They do have pigeon hole letterboxes but they are not used! Half of them have been ripped out from the entrance and the ones that do work are completely disregarded by the posties. They are also tiny so won't fit things like packages when I do order something. This is why I get everything sent to a different address. I have asked my landlord about secure mail before and his response was "what do your parents think". Facepalm!Le_Kirk said:
Complain to Royal Mail, this is totally unacceptable - someone has paid (an inordinate amount) for a stamp for a letter to be delivered to your address not thrown on the floor! If there is a management company, get them to install some secure pigeon holes with the backing of your landlord.greycats2025 said:In June, I then received 4 parking fines from UKCPS for failing to display a permit. These were sent to my family address which is where I have my mail sent as there is no way to securely receive mail at my flat (it's all just thrown at the bottom of the lift for the residents to root through).0 -
No need to be at all worried about a CCJ if you follow our advice
But you are right to be concerned about a future court claim pack from the CNBC in Northampton using MCOL arriving in the post, eventually ( within the next 6 years ) especially due to the number of pcns being over the £600 threshold
That doesn't mean that you would lose, you would probably win, or the case would be discontinued at some point
But getting the management company to cancel them should be your current priority3 -
Thanks very much. Even just hearing these responses are reassuring to me. My landlord has now responded saying he does not feel he should be responsible and has refused to pay. I have asked that he reconsiders or reaches out to the building management to see if they will cancel them. Although, I of course do not want to rely on him doing anything so depending on if/what he responds with, I will be contacting them myself.Gr1pr said:No need to be at all worried about a CCJ if you follow our advice

That's a good thing.
Your contract was silent about any permit scheme and UKCPS seem to have put signs up after the fact of your agreement, interfering with the free parking you already enjoyed.
As for anything else to do? Yes please! You and the law firm you work for: if you want to be part of the push to change things in future, it's very important that people like you tell the Government NOW that:
a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY (THEY WILL LAUGHABLY DEMAND £170 PER PCN NEXT - IT'S ABSURD THAT IT'S LEGAL).
c). Tell them about your experience and the fact that you are NOT prepared to pay £20 a pop to make UKCPS go away. There is a Consultation question about that scam clause in the current joke 'Joint Code'.
Responses are invited to the Consultation now:

Do it in August at the latest pleeease!
We will discuss it on that thread in more depth, by next week if you want some direction & ideas to focus your own individual reply.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Is there anything else I can do in the meantime? I would rather not just wait around and hope that proceedings aren't issued against me but I do understand that other than paying, this may be my only option!Yes, get hold of the lease like I said 😉
If they have no rights, they can be kicked

I actually really doubt that the landlord would provide it to meCar1980 said:Is there anything else I can do in the meantime? Fine, then your agreement is as per your AST. Like I said, you had prior rights. Did you read the Joint Code of Practice clause that covers residents? My landlord has now responded saying he does not feel he should be responsible and has refused to pay.Good! He's not stupid then! Of course you don't PAY these scams.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
