    Have you made affordability complaints about these debts? One to Newday covering both Aqua and Marbles, Loans 2Go and Drafty are both very high cost.

    yes I have all of them declined and now with the FOS. Except MBNA where still awaiting response

    CCA requests must be done as per consumer credit act regulations, that means in writing and you must enclose a £1 blank postal order as the statutory fee, you may find the fee is returned, but to comply with legislation, you must include it initially.

    thanks for that I will go to the post office today to get the postal order. I guess I address the postal order to Cabot? And leave it blank? Is that correct? Sorry I’ve never done a postal order before.

    Leave the PO order blank. Quite often they return it, so you can reuse.

    Thankyou :) and 1 more thing shall I send 2 CCA requests separately with 2 separate PO? As I have 2 debts which have been passed to them from Newday? Thanks

    Separate request for each and every account yes.

    You can just make an unofficial request for proof of your liability, by sending a letter asking as such if you have multiple debts.

    They should respond to that, and the usual proof would be a copy of a credit agreement.

    So its the same result, just obtained in a different way, the account would likely be deemed unenforceable in just the same way if they could not comply.

    Making a request under sec 77 is your statutory right and if they don`t or can`t respond, the debt is deemed unenforceable after 12 days, its just an official way of doing things.

    thanks to all. I have submitted my CCA requests and today received a letter back in the post acknowledging my request advising they are contacting my lenders for this information and they will get back to me. They have said my account is on hold until they respond. I assume they will be able to get hold of the required agreement they need off the lender without any issues with it not being a very old account?

    What is my next step now? I sit back and wait for them to send me an update via post?

    Yes, just wait until you get an update, and read it very carefully as they often word things to try and mislead people. Don't assume anything, generally speaking the chance of the cca being able to be produced decreases as time goes on, but sometimes it can't be produced for recent debts or they can produce them for very old debts.
