    Yes they have to answer you. Send it to Cabot but they should tell you Aqua will still have it.

    If you can't get a CCA they should let you know they can't find it but they will still ask for payment but if you have proof they can't supply a CCA you don't pay them anything, OK there is a slim chance they will find it later but cross that bridge if it crops up.

    There is a template letter on the National Debtline website you can use. If they don't provide it within 12 days then the debt is unenforceable until they do provide it and you can simply stop paying. They have to go back to the original lender so it's normal to get a acknowledgement letter and 2/3 months+ later they send an update when they have heard from the original lender. Read the response carefully as they often try and deceive people into thinking they have to pay when they don't. They have to provide the original agreement or a true copy of it, if they can't they often try and try anf fool you into paying by saying its valid and collectable or other such nonsense.

    Yes you always send it to the current owner.

    The consumer credit act is currently up for review, its quite likely section 77-79 will be revoked once the Government get around to it, or watered down even further.

    So use it while you can would be my advice.

    Is this imminent, or is it likely to be a few years away? I’m only at the very early stages so wouldn’t be looking to request these for 2-3 years.

    thanks guys appreciate all this advice!

    One question - I know originally I was advised to await defaults as these fall off credit report after 6 year…regardless of if the debt is paid or not


    what if companies like Cabot add add the debt to my credit report and then I’ve not paid it off within 6 years? Will it just stay on there as a payment arrangement until it’s paid off? I’m just thinking as if I for example paid them £10 a month on £6000 debt this would go on forever?

    Callum I have told you the default drops off after 6 years even if you never pay another penny off it.

    You must understand this and the more you can do to check if any of the debts are unenforceable the better it is for you.

    You are better to spend time now doing everything you can to check just what debts will have to be paid and not just jumping in and making payments when with a bit of work you if you are lucky may not have to pay anything.

    As well as that if you do pay something further down the line you may be able to clear them for much less than the amount you owe. This is why we tell you to keep saving as much as you can, not only to cover emergencies when you have no access to credit but also for reduced payments to clear the debts.

    You must realize these companies buy the debts for maybe 10p in the pound, so if they can convince you to pay the full amount they are laughing all the way to the bank.

    hi guys thanks for all this info please see below breakdown of my debts


    1 - new day Ltd (Aqua) credit card with balance of 5676 which was defaulted on 27/02/26


    2 - new day Ltd (marbles) credit card with balance of 2461 defaulted on 27/02/26


    3 - virgin money personal loan with balance of 3461 defaulted on 04/02/26


    4 - fluro loans with balance of 5620 defaulted on 06/01/26

    5- Loans2go with balance of 1275 defaulted on 22/12/25

    6 - gain credit (drafty loans) balance of 2137 defaulted on 29/10/25


    7 - MBNA credit card with balance 7161 which is still not defaulted yet but I have a pending affordability complaint in with them so this is maybe why?

    Out of all these I have only been contacted and advised about the 2 Newday account being passed to Cabot financial. The rest I have not been contacted by anybody else yet…


    would you suggest I do a CCA request to the Cabot financial? I assume I wait until the debt is sold on the others to someone and then do a CCA request for these too?
