    Well i've had an email response from moorside:

     We write in relation to the above matter. Please find attached a redacted landowner agreement. These Parking Charge Notices were issued at Meteor Retail Park Derby DE21 4SY for "Overstay" on Mon 29 Jul 2024, Thu 01 Aug 2024, Tue 30 Jul 2024 and Wed 31 Jul 2024. The terms and conditions were clearly displayed in and around the private location. When remaining on the premises, all motorists are required to park within the permitted time limit. As you failed to do so, these Parking Charge Notices were correctly issued. The additional charge which has been levied on your Parking Charge of £70  is the amount set out in both the British Parking Association and International Parking Community Codes of Practice as the amount which may be added to a Parking Charge when a Parking Charge remains unpaid and when further recovery is required. Our Client adheres to the ATA’s Code of Practice. The £70 does not represent the cost of recovery but is a reasonable amount in relation to the Parking Charge amount, in order to encourage early payment of the Parking Charge without the need for debt recovery. It is a fair amount set by our Client’s government-approved Accredited Trade Association Code of Practice. There are however also costs incurred by our client in relation to debt recovery services.

    By entering and parking the vehicle on our client's private land, you agreed to enter into a contract with our client and to be bound by the terms and conditions of that contract. The terms and conditions were clearly displayed at the entrance and in prominent places within the car park. Due to your failure to comply with the terms and conditions, our client has issued the PCN.

    If you believe that these Parking Charge Notices were incorrectly issued, please provide evidence to support your dispute. 

    How to pay There is still time to make payment to avoid the need for a Court hearing. You can do so in any of the following ways: -

    • Call 0330 822 9950 to make a credit or debit card payment 

    If you choose to make payment, please ensure you use your account reference number 10225904 as the payment reference to ensure we can quickly allocate the payment to your matter. If you choose to make regular card payments to us these will be made under a Continuous Payment Authority ('CPA'). This authorises us to take the agreed amount on a regular basis. CPAs can be set up weekly, fortnightly, or monthly. If we are unable to take your payment, we will attempt to take the payment later that day. If that fails, we will reattempt the next working day.
     
    If you wish to provide an alternative payment proposal, please contact us within 7 days of receipt of this email. We hope this matter can be settled without further Court action. You may wish to seek independent legal advice.

    They've enclosed a pdf of the agreement between the landowner and Hozah Parking. which is supposedly the parking management company as found in this pdf below.

    Ignore them and await further court directions.

    Hozah isn't the Claimant or on the signs I presume? UKPA isn't the same legal entity as Hozah.

    Technically Hozah Parking isn’t Hozah Parking Ltd and UK Parking Administration isn’t UK Parking Administration Ltd. Whether that invalidates the agreement someone with more knowledge of contract law would have to give you guidance but it does seem a bit slapdash

    Totally misleading and will probably have a judge in hoots of laughter ?

    The words plain stupid comes to mind. It all adds up to a DEBT RECOVERY CHARGE

    Clearly Moorside are misleading themselves and you plus the court

    When government approved ATA's and POFA debt collection charges were not part, it is an invented add-on called the OSNER SCAM OF ZZPS. The money scam was approved by the BPA and IPC. Just two private members clubs adding fakes ?

    AND … Moorside ignoring the Supreme Court ruling.

    So they haven't provided a copy of the actual agreement dated 07/07/2022.
