Dear Forumites,

First, I would like to thank you for the brilliant and important work you do to educate motorists and stop parking ticket scams.

I have received a PCN from Civil Enforcement Ltd. and usual letters from DCBL.
The last one from DCBL is "Final notice of debt recovery" and is dated 17/06/2025.
Below I enclose the PCN and my communication with Everyone Active and Civil Enforcement Ltd.
I have already updated my address on the registration certificate and driving license, and I have notified Civil Enforcement Ltd. and DCBL about my current address.
Please advise.

Dear Sir/Madam,

We are an Everyone Active member at Hamble Sports Complex, as my son attends swimming lessons there.
We use the Hamble Sports Complex car park regularly, which is the case for many members.
I'm a Hamble Sports Complex coffee van customer as well.
The car park is free for up to 10 minutes for everyone (also non-members), and members and coffee van customers can park longer. There are touchscreens to enter car registration.

On 27/02/2025 I was at the car park for about 15 minutes.
Likely I entered my car registration, and even if I forgot to do that, it would just be a minor human error.
It resulted in the parking penalty charge notice from the company you work with—Civil Enforcement Ltd.
This PCN was sent to my old address and because of that I was not aware of this, was unable to take action, and it changed from 60 pounds to 170 pounds.
I asked Hamble Sports Complex staff to cancel that. They felt it was unfair and said they would do that as we are a member, but their request has been rejected (i believe by Civil Enforcement Ltd) because it was too long since the PCN issue date.
I tried to contact Civil Enforcement Ltd., but they were not helpful.

4. Hamble Sports Complex staff felt this was unfair and tried to cancel this charge.
5. We exceeded the free parking time (available also to non-members) by just about 5 minutes.
6. The PCN was sent to my old address, and I was not aware of this. Otherwise, Hamble Sports Complex staff would be able to cancel this for me.
7. The PCN was sent to my old address, and I was not aware of this. Otherwise I would be able to appeal to Civil Enforcement Ltd.
8. The charge changed from 60 pounds to 170 pounds.
9. Likely I entered my car registration, and even if I forgot to do that, it would just be a minor human error.
10. Likely on that day I had a coffee from the Hamble Sports Complex coffee van.

I find this very unfair, abusive, and excessive.
I don't accept this charge, and I ask you to resolve it.
I understand that you did not issue this charge; however, it is your responsibility to make sure contracts you enter do not result in unfair/abusive treatment of your members.
Therefore, I ask you to urgently resolve this matter with Civil Enforcement Ltd. or reimburse this charge.

Thank you for your email and for providing the additional information regarding the Parking Charge Notice issued by Civil Enforcement Ltd.

We understand your frustration and appreciate your long-standing membership and continued support of Hamble Sports Complex. However, we must clarify that the car park is operated and managed independently by Civil Enforcement Ltd., and all matters related to PCNs, including appeals, payments, and correspondence, are handled solely by them.
As the operator of the leisure facility, we do not have authority over the enforcement or cancellation of parking charges, nor are we able to intervene once a PCN has been issued and progressed by the enforcement company. While we have forwarded concerns from members in the past, decisions regarding cancellations remain at the discretion of Civil Enforcement Ltd.
We regret that we are unable to assist further with this issue.
We recommend that you continue to pursue this matter directly with Civil Enforcement Ltd. through their formal appeals or complaints process.

As I have already mentioned, I tried to contact Civil Enforcement Ltd., but they were not helpful.
It is your responsibility to make sure contracts you enter do not result in unfair/abusive treatment of your members.

I am the general manager for Hamble Sports Complex.

As i previously explain the car park is operated and managed independently by Civil Enforcement Ltd., and all matters related to PCNs, including appeals, payments, and correspondence, are handled solely by them.As the operator of the leisure facility, we do not have authority over the enforcement or cancellation of parking charges, nor are we able to intervene once a PCN has been issued and progressed by the enforcement company.

    Do they own the facility? If so they are not telling the truth as they can cancel them as per their contract

    Yes. The facility name is Hamble Sports Complex and the staff and manager told me they could cancel earlier but now it's too late. It's possible they are not telling the truth but I have no way of knowing as I don't know their contract arrangements with Covil Enforcements Ltd.
    It seems to me they contacted Civil Enforcement Ltd. but failed to resolve it.
    Please advise how to proceed.

    You cannot appeal ( not complain   ) to popla,  that option would have expired months ago  !

    You wait for a Letter of Claim giving you 30 days notice,  followed by a court claim

    Again, as previously explain the car park is operated and managed independently by Civil Enforcement Ltd., and all matters related to PCNs, including appeals, payments, and correspondence, are handled solely by them. As the operator of the leisure facility, we do not have access to their systems or processes, so unable to comment on the allagation that communications were sent to a different address.

    Hi redacted,

    No need to repeat your POPLA unhelpful non-advice three times. I received it the first time.
    It is not helpful and doesn't lead to resolution of the issue, and you should understand that as the general manager for Hamble Sports Complex.
    Or perhaps you fully understand that but act in bad faith, which is even worse.

    You state that you are unable to comment, which I find not accurate.
    I have presented the facts in my complaints and messages, and you are able to comment if you choose to do so.
    I also believe you (Everyone Active) are able to do much more than just comment if you choose to do so and have a responsibility to do much more to not enable or cover for unfairness and abuse towards your customers.
    Therefore, I would like to ask you to not cloud and obfuscate our conversation.
    For example, you should write "I will not do anything because I don't care" instead of "I would love to help, but I am unable to" if the former is closer to the truth.
    That's just basic honesty and human decency.

    Anyway, you showed yourself to be unwilling to resolve this issue and/or acting in bad faith and/or lacking awareness and understanding about your responsibilities and/or lacking culture/abilities needed to resolve this.
    Therefore, I AGAIN ask you to escalate my complaint further within your organization. I still hope there are people better equipped to deal with this higher in your organization.
    I will consider any further delay or obfuscation to be acts of bad faith.
