  • Just use the Template Defence but copy from another Smart defence from this year, that points out that the POC includes the untrue statement that that you can be pursued under POFA. You can't. Smart didn't use that Act.
    Hi Coupon-mad. I guess I just search the forum for a Smart defence? of where would I included that, what section please? many thanks

  • Hi guys, going to submit the defence this week. 
    It just crossed my mind about the response pack thing that came with the papers. I guess I dont have to do anything with that except give it to my cat to rip up?

    Did you notice I just wrote a defence for a Smart case ten minutes ago? The second section that I just posted fits your case (except remove 'the Defendant was not driving' if that is untrue).

    And just a reminder even though we know this claim is stressful: before the end of next week please please do the government's Public Consultation.

    We need every poster to come back & complete this vital Consultation before the deadline. See this thread: -

    I've written some guidance on that thread. I have covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

    Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

    I did not notice originally, I have found it I think. one with the lad at the gym I assume? If so I have found and well use that with adaptions. Thanks again. I will have a read of the other thread you mentioned as well. This rip off cr4p really needs to stop.

    Upon receiving the original PCN, before I appealed the notice. As I was not the driver, I visited the car park in question at the same time of the claimed contravention. The level darkness was very high and the sparsely place small signs weren't not seen by the driver of the vehicle, there/were none at the wide entrance to the car park. The level of darkness is also clearly shown in the poor photographs that were sent. Its not even remotely clear what type of vehicle or what shape it is, The pictures show literally an index plate. My appeal to the claimant was ignored. The claimed vehicle in question was used as a ''pool car'' at the time and was driven/used by various family members and friends for various lengths of time. No records are held of this nor am I duty bound to keep any.

    Yes but the main thing to copy is my para 4 from the gym thread. Then renumber it all.

    Then move on to the vital public survey.

    A heads-up  -  the Defence is written in the third person  -  so it is "the Defendant"   -  no "I", "me" etc.
