Did you notice I just wrote a defence for a Smart case ten minutes ago? The second section that I just posted fits your case (except remove 'the Defendant was not driving' if that is untrue).crashbandicoot12 said:

The N1SDT claim form pack is from the CNBC in Northampton, not the court, no court is involved yet

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.
I've written some guidance on that thread. I have covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

Hi ladies/gents. I think I have written a response for Para 3, reads/sounds ok?
Upon receiving the original PCN, before I appealed the notice. As I was not the driver, I visited the car park in question at the same time of the claimed contravention. The level darkness was very high and the sparsely place small signs weren't not seen by the driver of the vehicle, there/were none at the wide entrance to the car park. The level of darkness is also clearly shown in the poor photographs that were sent. Its not even remotely clear what type of vehicle or what shape it is, The pictures show literally an index plate. My appeal to the claimant was ignored. The claimed vehicle in question was used as a ''pool car'' at the time and was driven/used by various family members and friends for various lengths of time. No records are held of this nor am I duty bound to keep any.

A heads-up - the Defence is written in the third person - so it is "the Defendant" - no "I", "me" etc.4

Well well well. some more paper work from the court dropped in today. ''Notice of Proposed Allocation to the small claims track'' included is an N180 form. One assumes I have to fill it in and return it. Its says I have until the 30th October to do that. I assume I have to do that??
Funny enough DCBL did send me and email 28 days after the defence went in. funny that. saying they have received this blah. They also the claimant is willing/maybe willing to settle out of the court. Nope. I didn't respond to that.
