PCN into CCJ - all correspondence to old address.

Hi all, unsure what to do with the following situation.

I lived in a flat with a management company looking after the car park. I twice got fined for parking in my own spot but not displaying the pass  (spaces were numbered for flats but still had to display a pass). The management company have been useless and refusing to assist with changing the parking company for the flats even with other resident support. I no longer live there but had post from the last 18 months forwarded to my address just recently and it has escalated to a CCJ and a final warning.

I am at a loss of how to fight this, especially as this has all orginated from parking in my own space and now I feel like I am being held to ransom. These parking companys are crooks and exercise no common sense. i.e the reason they exist surely is to protect the residents spaces not fine the residents themselves!

Any help would be appreciated.

    If you do have a CCJ against you then you can apply for a set aside, based on incorrect service of papers,  costing £313. Study the set aside advice in the newbies sticky thread in announcements near the top of the forum by coupon mad 

    However,  if its not a CCJ,  but an N1SDT claim pack from the CNBC in Northampton using MCOL,  you need to defend it,  after telling us the name of the parking company,  the legal company,  the issue date and attach a redacted picture of the POC from the lower left of the claim form,  after hiding your VRM details first 

    Do not post personal information or data here,  because its against the rules 

    Regardless of what went on , or your personal opinions, you need to deal with the legal ramifications,  not your feelings about the rubbish system

    I think it is just a CCJ. To clarify though I haven't had a letter from the court, just two letters from a Legal Company. I did a search on the Registry for £6 and it says their is an unsatisfied claim. Unsure whether I actually have one or not or whether it's just a threat. I am under the impression a CCJ comes from the court? Cheers

    Yes it would have come from the court, but it would have gone to your old address.

    Sounds like you have a default CCJ,  gone to the old address,  so use the claim reference number to get the details and then follow the set aside advice 

    You wont have received the paperwork due to it going to an old address,  a common problem,  but that non receipt doesn't mean it didn't happen,  it's all been done behind your back

    You now need to unravel the result, wind it back

    No.  Specific info is needed urgently.

    Read the CCJ set aside info in the NEWBIES thread second post.

    If you had unresolved PCNs (are they ones that you knew about?) why didn't you proactively give the debt crawlers your new address? I don't understand why anyone would move house and just risk CCJs like this, when all it needs is an email when you move.

    This is now a mess to unpick and stay on top of. We will help you - of course - but you must be proactive. You will also have to urgently reply to any other LBCs now, to stop more CCJs.

    I followed previous advice from another website saying to reject the ticket as an unjustified invoice which i did. I got one letter from a debt collector but I guess naively thought nothing would come of it. I

    I have a letter just recently forwarded to me from June 9th saying final notice before enforcement of the CCJ. Is it too late to send the email from https://forums.moneysavingexpert.com/discussion/comment/80636476/#Comment_80636476  ?  Or should I go straight to Henrik777s advice about setting aside the CCj? Cheers. Also what other info would be useful on this thread?

    Judges like to see prompt action taken if you want to have the CCJ set aside.  Twelve days have now passed since your last post.  Have you started the N244 application?

    No I was out the country for work. Should I do this instead of following the link above which advises a letter to the claimants solicitor? Or should I do both at the same time?
