The mediator is just basically a fancy title for a person that has had some training in passing a message between two people.

They have no interest, training, or expertise in the case, they only attempt to get a financial settlement prior to court.

Mediation call took place this morning.  To kick off I asked for the name, role/position within legal representatives firm and whether the said person held wriiten aurthority  to negotiate and settle during the phone call.

Mediator requesterd and confirmed name of representative, role given as Litigation Support and stated they had full authority to. settle

Almost fell off my chair when offer was passed on to me.  Chasing me for £284.72.  Opening with an offer of £35 to settle - first and final offer.  They rejected my offer of £1 - the original charge for 1hr hour after my 2 free hours.
They did, however, say I could pay the £35 in 2 payments over 2 months

Said I would defend in court.  Hope I haven't shot myself in the foot!!!!!

LOL, they are desperate to increase their 'case settled' percentages for December then. They just wanted to report a high % 'success' to ECP, to keep their lucrative business.

They failed in your case but we know they'll discontinue in 2026 anyway. No worries.

Just checked on MCOL and notification of transfer has been posted

Your claim was transferred to PRESTON on 28/01/2026

I suppose I just await the next correspondence in this pro-longed saga - however long that takes!!!!! Thankfully not received a dickie bird from the pusuers which I find strange although I don't respond to unknown or witheld. Thought I may of had an email or 2 but nothing. Dreading the thought of having to compile the defence and live in hope of discontinuation

You will have to write a witness statement (not a defence as @Gr1pr also told you) and the deadline will be on the Notice of Allocation when it arrives.

Apologies - I meant witness statement. Just relieved it has been allocated to my choice of court. In mileage, the claimants legal representations home court is my nearest!. Also had the foresight to mark I was unavailable for the month of July on the N180 and my witness unavailable June so should be able to enjoy a much needed few days in warmer climates.

Received in post today. Sounds promising however, who knows. I assume I do nothing or am I not understanding fully. Many thanks for continued support and advice
