  • I understand that i can't change my defence now, which is why I don't think there would be any benefit to me typing out my defence to post on here. Especially as its very long and has alot of personal information about my personal circumstances, which I dont want to share.
    Also its been suggested to me on here a few times to read other posts on here, which i have done only from what ive seen everyone else had a defence which helped them. This is not the case for me.

    But you can improve on it at WS stage.

    For now, you MUST comply with that order. Do it by email and by post (with a free 'certificate of posting' you must ask for when handing your letter in at a PO counter). Enclose with the form, a covering note marked URGENT and with the correct Claim Number.

    It says unless I file a copy by this Friday my defence will be struck out, not that it has been already
    It reads both ways. Badly phrased, like I say.

    But take Coupon-mad's advice. She's the expert.

    Reads like a lot recently, that the local court has lost your defence OR it wasn't sent from CNBC.  Follow the advice.
  • Hi everyone, I re-submitted my defence on time and would like to know what to expect next and how to proceed, please?

    Also this morning I received this letter for a car I had years ago. I vaguely remember receiving a letter about being parked for approx 15 minutes without obtaining a ticket. I was not aware at the time that I was on a pay and display car park and that evening i had planned to eat at the place i'd parked at with my son, we talked in the car before going inside, then when i saw how busy it was my anxiety got the better of me and I couldn't go in. I drove away. I don't remember what letters I received at the time and if I have any from when i had that car they would have been filed away years ago somewhere. I remember finding out that the car park ticket, had i have purchased one would have been 50p. 

    This letter arrived today 8 days after the date of the letter and states they will proceed with further actions if i don't respond within 7 days, so even if i was going to pay (which i'm not) I would have been out of time anyway?


    Please advise what i should do about these situations

    Next stage will be a letter with a hearing date, witness statement date and instructions for the claimant to pay their fee.

    For your new ticket file it away and start a new thread if you get a letter before claim.

    Will probably be from DCB again and so you'll go through the same process again and it'll probably end in discontinuance. Again.

    Your witness statement will be in the first person and be more an account of what happened on the day. It will include exhibits that stand in your favour - e.g. photos of the signage if they are unclear. Search the forum for examples.

    In terms of 'What comes next', there's a step-by-step guide (12 steps in total) in the Template Defence Announcement. 

    Both the above can be found in the first 5 Announcements of the forum thread index.

    I recommend you start a brand new thread for the ZZPS/Smart Parking letter as this is a quite separate case in which you are at a different time point for dealing with it. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • I'm worried that i'll make a mess of the statement because a lot of what i've read on the forum, I read pages of different threads before i joined, went straight over my head. I have no idea what is relevant to my situation and what is not.
