    Hi all,

    I’m looking for further advice regarding a rejected appeal from UK CPM.

    I have tried getting the landowners info from various businesses in the business park but no one knew who they were. All of the people I spoke to complained about the treatment they received from this parking company - issuing tickets to the owners of these businesses and to their clients. Really unhappy crowd I believe. 

    • Date of Parking Event: 18th April 2025 and 21st April 2025

    • Location: [Private retail/industrial road – used for parking near Lidl]

    • Vehicle displayed: Blue Badge for severely disabled child with epilepsy

    • Appeal Reason: Signage unclear, road marked with misleading double yellow lines, parking occurred after working hours, no obstruction, blue badge displayed for disabled child

    • Initial Appeal Outcome: Rejected

    • Next Options Offered: Pay £60 by 2nd June or appeal to IAS (with warning that the discount is lost if I do)

    My concerns:

    • The signage is tiny and unreadable unless you’re standing still (and with glasses).

    • The car was parked carefully due to emergency risk – we need to be near medication/hospital access for our child.

    • Parking was during non-business hours and didn’t affect traffic or block any entrances.

    • The Blue Badge was displayed, and this was a medical necessity, not carelessness.

    Please see the redacted copy of the rejection email from UK CPM below.

    What I need help with:

    • Should I appeal to IAS, or will it be a waste of time?

    • What are my real risks if I don’t pay this and just ignore them?

    • Any advice on how I could strengthen a case if it goes further (medical/emergency access, disability rights, etc.)?

    Dear XXXXXX.

    Thank you for your appeal against the above Parking Charge Notice.                             

    At UK CPM we consider all appeals on a case-by-case basis. We take each appeal very seriously and thoroughly investigate any evidence that has been provided. We appreciate your circumstances and understand this is not a situation anyone would like to find themselves in; however, these parking conditions have been put in place to ensure fair usage for all motorists and support the needs of our client. After careful consideration, it is unfortunate that I am writing to you today to advise that on this occasion, your appeal has been unsuccessful.

    The decision to uphold your parking charge notice has been made on the following basis.

    Whilst we note the comments and reason for appeal, as per our photographic evidence, the vehicle was parked in contravention of the advertised terms and conditions. As the vehicle was parked in an area where no parking is allowed, we can confirm that this PCN has been issued correctly. 

    Either due to the reason for issue and/or the insufficient evidence provided to support the details of your appeal, we have considered this PCN and found that it does not fall under the category of Annex F the Appeals Charter of the Single Code of Practice. Therefore, if no further evidence is provided, we will deem this to be our final decision.                 

    You have now reached the end of our internal appeals procedure and therefore you now have two options; either pay or appeal to the Independent Appeals Service (IAS) - you cannot do both.

    To make payment of the total amount due as shown above, please use one of the following payment options;

    • Post: Payments & Collections, PO Box 3114, Lancing, BN15 5BR

    Alternatively, if you do not agree with your internal appeal outcome and you wish to dispute the matter further, as you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 28 days of this rejection.

    The Independent Appeals Service (www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of this type. If you decide to appeal to the IAS, you will need to visit their website and use your PCN reference and corresponding vehicle registration. All PCN's will be uploaded to the IAS website by the end of this working day.

    If you appeal this charge further then you will lose the ability to pay at the reduced rate (if applicable). In the event that your IAS appeal is unsuccessful, the full amount for the PCN will then be payable. If you lodge an appeal with the IAS and then subsequently pay the charge prior to that appeal being determined, then the appeal will be withdrawn, and you will not be given a further opportunity to contest the charge.

    If you do not wish to dispute the matter further and payment is not received within 28 days of the date of this correspondence then additional charges may be incurred, for which you may be liable. If the charge continues to remain outstanding, the matter may be later referred for litigation in the County Court which could result in a County Court Judgment being made against you; this may impact on your ability to obtain credit in the future.

    Dear Sir or Madam,
    I am writing as the registered keeper of the vehicle in question. I dispute your 'parking charge' and deny any liability or contractual agreement with your company. I will also be raising a formal complaint with your client landowner regarding your predatory and misleading conduct. No admission is made as to who was driving, and no assumptions should be drawn. The driver is not identified. I will not be paying your demand for payment for the following reasons: The signage you displayed is forbidding and unable to form a contract with anyone. The signage is too small and the terms are microscopic for anyone to read especially if you cant see without your glasses. You have marked your road with double yellow lines continuing from the main road. Obviously trying to trap people into going against your rules. If you dont want people to park, why didnt you use double red lines? You should copy the authority rules by putting two yellow lines on the curb too. The occupier of the vehicle was a disabled child with severe epilepsy. The blue badge was displayed properly in the front windshield. The driver had to be close to the Lidl shop as if there was a serious epileptic seizure need for emergency equipment, medication or possibly drive to hospital is paramount. Parking occurred after normal working hours and all businesses this road is serving are closed at that time. The car was not obstructing any traffic or loading and unloading. The charge is disproportionate and not commercially justifiable The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner. Your PCN lacks clarity and appears to be a generic template. Therefore, I request the following: A full explanation of the allegation; Your photographic evidence of the vehicle; A close-up, readable image of the signage you rely upon, clearly showing its content and position as it would have appeared to a driver on the material date. This is a formal request under the International Parking Community (IPC) Code of Practice and relevant consumer contract law.     Appealing to the IAS Kangaroo court is a total waste of time, the IPC brag to prospective members that only around 4% of appeals are upheld, this is about money not fairness.
    I would wait for a court claim to come through where a fairer decision will be made, or the dimwits will cancel it at the eleventh hour.

    SOME IDEAS FOR DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £7 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.

      Waste of time. Kangaroo court where only 5% of appeals are found in favour of motorists.

    OK - sorry guys for a break in communication. We had a ruff last month. I still have not found who owns the land. I will keep trying. The appeal was unsuccessful. the reply email ended in my junk folder and i just found it as i received the debt collectors letter for both tickets. I read the FAQ section and think that, maybe, there is still a chance? Can someone put my and my wife's mind to rest please. Can we still win against these bloodsuckers?

    You're at the 'ignore debt collectors' stage. Nothing you can do to halt them, other than send a cheque. Debt collectors are harmless, so sending them a cheque just to stop them sending you silly letters wouldn't make much sense.

    If you receive a Letter Of/Before Claim from the PPC's solicitors, or a County Court Claim via the Northampton CNBC, come back to this thread for further advice. To get ahead of the curve, you could prepare yourself by reading the NEWBIES FAQ Announcement, second post, and the Template Defence Announcement, both situated near the top of the forum thread list.
