Hi all,
Is the claim now stayed?
I've recieved nothing further than what has been detailed on this thread.
Claim Form received 21 Mar,
My MCOL response 25 Mar,
Defence email sent 20 Apr,
Letter from CNBC 30 Apr.
Thank you.0 -

What is the relevance of the 28 days having elapsed with no response from the claiment?0

Hi all,
I'm trying to determine how 'likely' it is the claim against me will continue, and, what the benefit of my recent actions might be.
Update - 28 calander days has now expired* since Letter from CNBC 30 Apr.
Whilst processing and notifying me of a stay 'takes months'. Can I assume the claim is now 'somewhat' blocked due to time expiry and a lack of further correspondence?
Unless the claiment wishes to challenge the stay in however many months time it takes for cnbc to process the stay?
Can also assume from the parkingeye/dbl behaviours monitored via sharing on this forum, such a challenge is unlikely? (None withstanding specifics of a case).

Assume nothing , but , I predict that....
The claim will continue , eventually
There is no evidence of a stay or a bar on that claim history
Just sit and wait for something to happen, speculation is pointless and you have no way of knowing where it's at1 -
There won't be a stay.
This stuff takes months.
Why not just read a few completed cases linked in @Umkomaas' DCB Legal discontinuances thread?

Thanks both,
My confusion results from the letter sent to me by the CNBC, HM Courts & Tribunerals Svc), content attached:
My question over a 28 day time lapse resulting in a stay originates from this evidence.
It seems contrary, or seperate in a way I don't understand(?), to the view it will take months.
According to the court letter, it says 28 days, then if no response a stay.
What variable/factor am I not appreciating?
Regards

That you don't know the date that the CNBC sent the defence to the Claimant. That letter is normal.
