Just providing an update on this (for myself to keep track, and for others who have been following)

    • Submitted defence via email. Included supporting evidence stating the ticket was cancelled.
    • Received a letter from DCB Legal saying that their Client (G24) had reviewed my Defence and intended to proceed with the claim.
    • Filled in the Directions Questionnaire and emailed to CNBC and DCB Legal - have received automatic replies.
    • Waiting to hear from a mediator next.

Thanks Coupon-mad and Gr1pr for your guidance so far!
And I hope you are reading the Public Consultation thread and plan to come back in August as we discuss how to respond?

We need EVERYONE affected by unfair PCNs, useless appeal decisions and/or now threatened by court claims, to individually respond.

A perfect example of a mediation exchange of views and standpoint

They will eventually discontinue,  just before the hearing fee is due,  probably next year
  • Perfect. I'll hold tight for the time being.

Admittedly, they did scare me a bit and have me worrying that I'd lose in court with them saying that they never received notification of the cancellation prior to the template defence stage.

But the Claimant (alleged creditor) isn't DCB Legal. The Claimant is G24 and they knew.
This case will be discontinued by the new year.

While your case is quiet now this month, please do the Government's survey if you didn't already. Deadline extended to 26th.

  • Quick update. I've received a letter today "Notice of Allocation to the Small Claims Track (Hearing)" where it looks like I need to be in court early December for a hearing. I just wanted to double check what I need to submit as evidence and what I need to prepare for on the day:

Given the crux of my defence is that the ticket was cancelled, is the email between the Landowner and G24 sufficient evidence or is there anything else I should be including?

On the thread it looks like I'll receive a copy of the Claimants Witness Statement and that I should use this to draft my own then send this to the courts along with a Costs Assessment and the above evidence.

Hope they discontinue at this stage, but if not then go to the hearing with notes, printed copies of both WS and evidence. Are there any questions I need to pre-empt or is it just a case of stating "yes I was there but the ticket was cancelled by the landowner."

    (Did the Government survey btw)

What are the deadline dates in the letter?

    No chance of a hearing.
