Had mediation call today, jist of it was:
- They offered a settlement of £269
- I said my point, that the Landowner cancelled the ticket with G24 back in March.
- DCB Legal saying they never received proof of cancellation (this is where I ballsed up earlier in the year by failing to let them know and assuming G24 would do this - didn't tell them this) - proof of cancellation however was sent with the template defence.
- Little bit of back and forth over why it took so long to have the ticket cancelled. I countered with I received one letter back in 2019 - then there was a pandemic - then didn't receive anything from them until the beginning of this year.
- I offered £5
- They said they wouldn't accept lower than £170
- I said I wasn’t willing to offer more than £5 as: a) the ticket was cancelled and b) £170 for staying over by 9 minutes was unjust.
- End of call

In a thread the other day they did send proof to DCB Legal and they just said it was insufficient. They are hybrid debt collector solictor a.k.a. bulk litigators, so they don't listen to reason.5

Quick update. I've received a letter today "Notice of Allocation to the Small Claims Track (Hearing)" where it looks like I need to be in court early December for a hearing. I just wanted to double check what I need to submit as evidence and what I need to prepare for on the day:
Given the crux of my defence is that the ticket was cancelled, is the email between the Landowner and G24 sufficient evidence or is there anything else I should be including?
On the thread it looks like I'll receive a copy of the Claimants Witness Statement and that I should use this to draft my own then send this to the courts along with a Costs Assessment and the above evidence.
Hope they discontinue at this stage, but if not then go to the hearing with notes, printed copies of both WS and evidence. Are there any questions I need to pre-empt or is it just a case of stating "yes I was there but the ticket was cancelled by the landowner."
