G24 DCB Legal court claim

Hi All

Posted about this some years ago and at the time I got advised to ignore, which I did. Have had a read of the newbies thread but just wanted clarification on a few things:

Backstory
  • Received parking fine from G24 for staying in Attercliffe/Meadowhall Retail park 9 minutes over the allotted 3 free hours. Dated 7th May 2019.
  • Emailed them at the time disputing the excessive charge of £120 and the fact the signs were tiny and therefore unreadable when driving into the park. Didn't admit liability.
  • Then came across this forum and posted asking for advice - got told to ignore as it's G24.
  • Emailed the landowner requesting a cancellation. Didn't hear anything back.
  • Pandemic happened. Stopped receiving letters. Eventually moved to a new address.

Now
  • They've clearly traced me and I've started getting letters from them again. Again, ignored these.
  • Yesterday received a letter from DCB Legal stating a Letter of Claim (dated 20th March)
  • Have again, tried to contact the landowner/agent asking for it to be cancelled - no response as of yet.
Questions
  • Am I right in thinking that - if the landowner/agent doesn't reply - I need to reply to DCB Legal no later than19th April (30 days from date of letter) stating that I am seeking debt advice but i deny any debt and the case must be "put on hold" for not less than 30 days under the PAP for debt claims 2017, and that i have sent the client a SAR?
  • I'm hoping the statute of limitations comes into play here given it'll be neeeearly 6 years since the alleged offence. Is this relevant here? I suspect this is a last ditch attempt to claim some money.

    Yes, you need to do everything to drag it out past 6 years. But use email, not the post.

    There seem to have been a few of these lately.

    As above,  try ping pong to drag it out past the 6 year deadline,  if possible,  hoping that no court claim arrives

    PCN Dated 7th May 2019.

    Reply to the LBC on or around 15th April and make sure you say you're seeking debt advice and require a 30 day hold. Use the template LBC reply but not until around 15th April.

    That gets you past
    7th May 2025.

    Quick update: finally got passed the correct details for the owner of the carpark and they cancelled the ticket. So, a win!
    Errr great...

    ...but because PPCs wash their hands of cases once passed for bulk litigation, there's a MASSIVE danger that nobody will tell DCB Legal unless you do.

    So you MUST still reply to the LBC on or around 15th April and make sure you say you're seeking debt advice and require a 30 day hold. Use the template LBC reply but not until around 15th April and add the proof that the landowner has cancelled this particular PCN.

    Unfortunately I've only just seen this and...have received a letter from HM Courts & Tribunal Service stating:

    "We are contacting you because someone claims you owe them money, and a money claim has been made against you. You must respond to the claim before the response date on the enclosed form. If you do not do this, the claimant could request a CCJ against you." 

    ....help?!

    Post a redacted picture of the claim form after hiding the following 5 details first

    On the left

    Name 
    Address 
    VRM details 

    On the right 
    Claim reference number 
    Password 

    Ensure that all the above cannot be read

    Presumably its an N1SDT claim form via DCB Legal for G24

    No worries. Just means you've got to do some paperwork now! What are the particulars of claim?

    Go to the newbie sticky, and you will find the template defence. You will be creating one paragraph yourself (number 3). I wouldn't even get into details since they will discontinue. Too difficult for them to prove anything from so long ago, and there is such a blizzard of these old G24 claims there is no money to be made in actually going to hearings.

    Just say the landowner has cancelled the ticket in that paragraph. 

    Have you got the landowner cancellation in writing?
