Hi guys just doing my email to dcbl in response to the consent order could you please have a look and see if it seems ok, thank you again for your help so far you’ve all been amazingDear xxxx,I’m response to your previous email and attached draft order of consent, I am not prepared to pay any monies to settle this claim. The cost of two PCN’s which I was not the driver and is over 6 years old and the other 5 years old, I have not received any correspondence for these claims and they have been extortionately inflated.Since receiving the only correspondence I have which was the high court attendance letter I have acted promptly and within good time to get the issue which I can only describe as extortion resolved, I am now out of pocket by £303 pound for the set aside hearing and also my time and the emotional stress that this has caused to me and my family life.Your fees have escalated dramatically since the ccj has been awarded, it also seems that the Government Capped £75 compliance fee has not been adhered to as per hceoa.org.uk
I will be making a formal complaint to hceoa. And request a full chronology of events that you hold for my caseYours faithfullyxxxx0 -
That's muddled. That's nothing to do with a consent order (DCB Legal). What does this have to do with the law firm or a consent order? Nothing...
What you've shown us is an email for the BAILIFF company DCB Ltd, which should be headed:
Formal complaint about HCEO enforcement fees being added prematurely
and needs to state a chronology of the exact figures that they demanded and when, starting from when you first rang them as soon as you heard about the CCJ.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is a response to the consent form. So am I best to leave in the 1st 2 paragraphs regarding the consent order and take out the other 2 regarding hceo and send that in a separate email to DCB Ltd0

so I have had a reply from dcbl please see below, I believe they have agreed to set aside and cancel the ccj and settle the case with no money to be paid, as they cannot attend the upcoming hearing.1 -
Yes that's right and they don't want to pay your costs. They were never nailed on in your case anyway...
So, your choice. Either:
1. attend the hearing mainly to ensure the Judge uses YOUR draft Order and grants your costs. singing for your supper, if you like. However, that's less likely than most cases because the claim form was served at your house and your wife picked it up (wrong person responded so no defence was filed).
or
2. Reply to DCB Legal and cc in the court hearings email (TODAY, NOW, BEFORE THE WEEKEND) and say you AGREE to the terms of the Claimant's Draft Order and ask that the court please pass the file back to the judge (if they agree) to use the agreed draft Order and vacate the hearing. Seems to meet the Overriding Objective not to have an attended hearing in this case, given the Claimant has already agreed to the CCJ set aside (CPR 13.3, applies) and has also agreed to the dismissal of their claim and is not attending anyway.PRIVATE 'PCN'?
