This is the same case where because the court office did not process my defence, 8 months ago they incorrectly entered a judgement for the claimant, stating that I had not responded to the claim, and then subsequently set that aside - because I had. It appears that the courts are not only under a huge backlog, but quite possibly the clerks and other support staff may be running on auto pilot because I draw the assumption that the DCA's are perpetually emboldened by their own bullying and likelihood that because this marathon is fraught with BS errors like this, many defendents either give up or get lost en route.1 -
- On 17th December I received a sincere apology from the court.
'Upon reviewing your case and the documents provided, we have identified that the email version of your directions questionnaire (DQ) did not include the dates you were unavailable foir a hearing. This appears to have been caused by a technical error during processing.
However after examining your hard copy DQ, we can con firm that you clearly indicated your unavailability between 09 January and 26 January 2026. In light of this, we will vacate the hearling currently listed for XX JAn 2026 and arrange for it to be re-listed on the next available date outside your stated period on unavailability
We sincerely apologize for the inconvenience and anxiety the issue has caused. Please be assured that we are taking steps to ensure the matter is corrected promptly. You will receive formal confirmation of the new hearing date in due course'- Today, I received two letters, both dated 22 December:
- The first was from the court ' N172 - Notice of Trial Date', providing the new date for the trial
- The second was from dcblegal:
