    Courts are very busy, the system isn't working plus not enough staff, so varies immensely,  but I would suggest maybe 2 or 3 months before the court order,  with a hearing date likely to be next year 

    Ps, there wont be any further involvement or updates on MCOL or from the CNBC in Northampton

    So, the Notice of Transfer of Proceedings was triggered by the outcome of the Mediation, not an indication that the claimant has indicated a willingness to continue with the claim, and pay the additional fees to do so?

    Thats correct,  there is a process to follow,  a court or justice driven process 

    The indicator you mentioned comes at the hearing fee payment point in several months time,  so near the WS bundle stage 

    I doubt that the claimant has any idea of what is going on

    It's not an indication that the claimant has indicated a willingness to continue with this CEL  claim, it's the normal automated process.

    But because it's two PCNs they might not discontinue. Usually do but in a two PCN case they sometimes carry on,

  • Hi all, i have an update c/o letter received.

    Notice of Allocation to the Small Claims Track (Hearing)

    The claim will be heard at the County Court at XXXXXXX on DD MM YY.

    I am not able to make that date. I made it clear on my N180 directions questionnaire that I was unavailable on that day.

    I have looked around to check to see what I should do to let the Court know. I saw reference to a N244 form, but I also saw that there is a fee to do so.

    Please could I ask the forum experts for advice?

    If you complete a N244 form it will cost you pounds!  I suggest you send a copy of your N180 and the Notice of Allocation to the court where the hearing is due to take place and complain that they have ignored their own process and your wishes.  If any other dates have become unavailable in the meantime, let them know of those also.

    Yes just email the local court and ask that your complaint is passed to the Court Manager urgently to rectify this hearing date error. Then badger them by phone next week as well. SAY NO if the clerk says you must fill in an application, and insist on speaking to the Manager.

    Meanwhile, letter received this morning from dcb legal (sorry I cannot scan in a copy of the letter from this laptop today). I have retyped it here:

    'In order to assist the court in achieving its overidding objective, our client may be prepared to make an offer to conslude this matter. A settlement at this stage would avoid further petential costs being incurred. We therefore ask that you call us on 0203 838 7038 as soon as possible to discuss this further

    We look forward to hearing from you'

    I do not have any intention of calling these shysters, and getting caught up on a call with a low life, dog butt paralegal for the purposes of trying to subjugate me. Unless I am advised here to do so in case it prejudices my defence.
