Claim Form Received from UK Car Management Limited

I have received a claim form in my name today, but I was not the driver. Apparently this breach took place on the 05/03/2024 so a year ago.

The Claimant is UK Car Park Management Limited and the Solicitors acting on their behalf are Gladstones Solicitors. It clearly states in the POC that 'the driver of the vehicle with registration ******* was parked in breach. As I was not the driver and cannot remember who the driver was how to I respond to the claim form, because when I select I defend for other reasons it is asking me the reason.

    I am panicking because I was not driving the vehicle and have never parked or visited the alleged Retail Park. Could I still be pursued to pay?

    Despite them mentioning the Country Courts Act - their claim is just a request for money.
    I can write you a letter demanding money too, if you like! :-)

    With a Claim Issue Date of 3rd March, you have until Monday 24th March to file an Acknowledgment of Service('AOS').  Do not file an AOS before 8th March, but otherwise there is nothing to be gained by delaying it. 
    To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an AOS in a timely manner, you have until 4pm on Monday 7th April 2025 to file a Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.
    Don't miss the deadline for filing an AOS, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

    Hello,  

    Is the above POC adequate? Or can I argue that it is not adequate as it is alleges  the driver 'parked in breach of the terms of parking stipulated on the signage (the contract)'.

    Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.

    I am in the process of drafting my defence but after looking for some time now I am unable to locate a defence which is similar to mine where the keeper was not the driver at the time of the alleged breach. Could you advise where I could find this.

    Of course, that's what the POFA Schedule 4 can allow under certain circumstances.  Stop panicking though.

    Dead easy to defend a Gladstones Claim and I even give a link to special wording for GLADSTONES claims, in the FIRST post of the Template Defence thread.  This isn't difficult or scary. Easier than an appeal would have been.

    Thank you for your response I have been looking for the Template Defence thread for the past hour. Is it under how to submit AOS?  If I am unable to locate it would it be possible to link it.
