Moorside Legal are not going to change,  it's all part of the expected ping pong process,  a court claim will end this saga one way or the other

Dont believe what the opposition tell you, they are biased and not impartial,  they don't work on your behalf
I’ve just contacted dvla I’ve got to write to them as they wouldn’t tell me the reason they gave for obtaining my details, the court won’t rule in their favour surely when there’s cctv proof? I’m not sure what the next steps are, what would you advise? Can they go to court for a ccj without Informing me?

    OP
Have you contacted DVLA to ascertain what reason(s) they gave when requesting your details?
Erm no I haven’t contacted dvla, would that help if I did? I’m not sure what I would say to the. Or what their contact number is
Why not make a complaint to the DVLA that Moorside are misusing your data (obtained by Forecourt Eye for one purpose only which is to identify the driver) and that Moorside are lying about keeper liability. No such law exists outside of private parking. This isn't a parking case.

Moorside are lying about keeper liability.

Nobody said phone! You already have all the right DVLA complaint emails provided in the fifth post of the NEWBIES thread,

    This isn't a parking ticket.

The POFA 2012 does not apply.

Both Trace and Moorside have lied to you, which is a breach of the DMCC Act 2024 and worth the CMA looking at.

Also how did ForecourtEye get your data? Are they the ones connected to UKCPS?

I wasn't commenting on your case or cctv or any possible future court claim or case

I never mentioned phoning the DVLA either,  you should not be phoning anyone  !

I said read the typical response to your query by member Umkomass, where you email the dvla and they reply by post

So one step at a time

Should a court claim occur in the future,  the government business centre will write to you by post, so you definitely will know about it,  thousands of claims are issued per annum, by post,  defendants definitely know about it if the correct name and address are used and they open their letters promptly

Dont get ahead of yourself,  deal with the processes as they happen,  if they happen,  no speculation

If I email dvla how would I word everything correctly also would the email be to the complaints department? Again I haven’t ever done this and I’m a little stressed keep being chased by different companies that don’t listen and lie about laws that don’t exist

The umkomaas advice is also in this thread

    https://forums.moneysavingexpert.com/discussion/comment/77638437/#Comment_77638437

    But

You are expected to compose your own enquiries

Ps, I haven't ever been through this too, most people haven't

You came to a free advice forum and have been given the best free advice in response to the issues being raised, so all you can do is run with the responses and gather your evidence etc

It doesn't matter what those companies think, or what Moorside Legal believe

What matters is the outcome if a claim is made

We are all learning from your unusual case  !

Well, if the CCTV image shows your family member I would point that out in a letter/email and give them said family member's details

But that's just me as I would be sufficiently irritated to go that
    wobbleted1 said:

I’ve tried telling Trace this and giving details.

Which I’m more than happy to do but they didn’t want to know, just told me that because I’m the registered owner I’m liable, even laughed when I pointed out the cctv images show a male which I’m not.

He kept saying they will obtain a ccj.
    Coupon-mad said:

    Wow.

You are not responsible for the criminal actions of your relative, they are just trying to scare you into paying. Don’t speak to them again , write to them informing them of the name and address of the culprit. Tell them that you will treat any more threats as harassment.

Keep a copy and keep proof of posting.
Thank you I will write to them and send it recorded so I know they’ve received it, it made me panic as I’ve tried twice to talk to them and each time hasn’t been pleasant especially with being laughed at and then threatened with court action. I’m hoping the letter will put a stop to their harassment but given how they behaved on the phone I doubt it.

    wobbleted1 said:

I have finally received a response today from shell saying that I had to contact forecourt eye support as the issue is with them and trace so I sent an email explaining and this is their response. Their still pushing that I’m liable because I’m the keeper 🥲 where do I go from here please

    Coupon-mad said:
But there is no applicable keeper liability law
    Coupon-mad said:

    Dear ForecourtEye 'team',

Explain to me the law under which you are claiming keeper liability? I'll be referring your replies to my MP so think carefully,

    Yours sincerely

Finally got a response and it’s not good, I’ve sent all email proof, told them to just take me to court, I’m getting no where with anyone
    Even more...wow!

    The outright lies!

    What happened in the end?

Last we knew, BPA President Mike Marrs' finest 'legal' company - Moorside Legal - were lying that keeper liability applies even though this isn't a parking matter.

This is serious illegal conduct: breach of the DMCC Act. Possibly fraud by deception too, as Trace and their sister firm Moorside have both lied to a keeper to obtain money the keeper cannot be pursued for.

And one wonders if IPC ex-wheel-clampers UKCPS are using/abusing their KADOE link, if not, how are ForecourtEye getting data?

Gary Deegan is a director of both UKCPS and Forecourt Eye:

    https://find-and-update.company-information.service.gov.uk/officers/kplqzNHP_KfbgBeaL2BfAGoHXUw/appointments

Looks like they use paper access to the DVLA and have been VERY heavily pushing the DVLA (aggressively?) to let them use KADOE and were refused, so there will be a file about them at the DVLA that the Government might want to read:

    https://forecourttrader.co.uk/security/forecourt-eye-acknowledges-vastly-improved-dvla-service-after-years-of-lobbying/668780.article#toggle

I am providing evidence to the MHCLG about these. Could you please kindly post a pic of:

     - both sides of the £100 PCN

    - all subsequent letters

    - all emails from Trace Debt and Moorside

And please update us as to the latest
