Parking Ticket CCJ set aside by Court but now parking company asking for £250 to settle claim

    I have requested assistance from the Small Claims Mediation service, although all the tel numbers listed for them on Government website, and their own website are ALL incorrect.  It is a joke and a seriously inept service provided by them throughout the whole process, the legal service is definitely geared towards the Claimants and not defendants! 

    I am hoping that by emailing the Small Claims Mediation service, I can halt the process and may ??? get some assistance regarding this matter.  It is extremely stressful and I wish the Government would stop letting these parking companies get away with charging extortionate fees, and taking people to court. 
    It won't halt the process. Mediation is a waste of time for parking cases but you are doing the right thing because the Judge ordered you try! There is no assistance here. Mediators just try to make Defendants settle. That's their job.

    PLEASE tell 
    the full story of this saga to the CJC this week.  Including the wrong address, CCJ shock, shelling out £275 (even though bunging in the rogue claim inly cost the Claimant £35) then the wait for a hearing, the error in the Order in January and the farce of Mediation and the phone numbers. All of it.

    There is a sustained & complete abuse of the court system by PPCs with third party 'bulk litigators' churning copy & paste generic and inflated/enhanced claims out (with no 'case merit' or address check) and adding fake damages/costs.

    You can only attach a Word document to submit evidence but you can put images on a Doc. Tell your story including this latest farce with wrong mediation phone numbers published.

    The main point to make is that the CJC and MoJ MUST step in and stop parking firms from ruining good people's lives and peace of mind, putting their credit rating at risk, having used an old address (no checks; zero attempt at compliance with the Civil Procedure rules).

    Ask why court time is being so much wasted on propping up 'scam' (almost always discontinued or lost by the Claimants) claims from PPCs? You've even been ordered to 'mediate' which is only relevant where a debt is really owed such as real consumer/small trader contracts. Not appropriate for unfair 'scam' parking charges!

    Enquiry closes on Friday so this is urgent.

    I really appreciate your help in this matter, and hope that soon the CJC and MoJ take notice and do something to stop these idiots being able to submit these bogus claims.

    You could respond and offer a tenner or respond and suggest you both 'drop hands' and walk away (assuming you don't have any reserved/unpaid costs outstanding).

    BTW which email do QDR contact you from? Might help others to know the QDR email to use for parking cases.

  • After contacting the Small Claims MEdiation service - they are offering mediation and I assume that they have contacted the Claimant regarding this offer too.  I cannot believe how stressful this is all the time, waiting to hear what the next step is going to be from the Claimant.  As the claim was stayed until 7th March, I am wondering if I will have to go to court again.

  • Well it looks like QDR are not giving up, as I have now received all the evidence (the date of the offence was 6.3.2019 - does this mean that it is actually expired 'statute barred or not?). 
    They have sent another counter offer and they have advised they will engage in mediation.  Does anyone have any advice on what steps I should next, or should I leave it and see if they take it to court.  What should I do next?
