Parking Ticket CCJ set aside by Court but now parking company asking for £250 to settle claim

Hi, I hope I am posting this in the right place. 
I recently attended court to set aside a CCJ which was sent to an old address 3 years after I had moved, and I had updated my DVLA information.  Therefore the CCJ was set aside based on the CPR 13.2 due to improper service by the Claimant plus the Claimant was ordered to pay costs. 

However, I received a letter from the UK Parking Control legal team on 18th Feb, so a week to make payment, asking me to pay £250 to settle the claim, see below.

'In the interest of the overriding objective, the Claimant is willing to settle the claim in final settlement of £250.00.

 

Should you accept the offer to make payment or wish to discuss the settlement offer please contact us by no later than 12:00pm on 25 February 2025.

 

Should this offer not be accepted, and the matter proceeds to a hearing, the Claimant will be seeking further costs and interests.

 

The QDR bank details have been attached for your review, if payment is made, please email back to confirm.

Please can anyone provide any help on how I should deal with this request as I do not have £250 to pay the company, and I feel this should back to the original parking notice fee, not this inflated costs.

    What happened at the set-aside hearing; did the judge, as well as setting aside the CCJ, make any order for you (the defendant) to submit a defence for the underlying PCN or was it struck out?  Did the judge make an order for the claimant to pay you and for how much; hopefully it included your set-aside fee?

    No, there was no order to submit a defence, and it was not struct out. 
    The judge did make an order for the claimant to pay the set aside fee which they have done.

    Show us the Order please. It must point the way ahead, surely?  You must have been ordered to defend now?

    Of course you don't pay them, nor do you offer the original sum. Ignore that letter but show us the Order.

    What a numpty judge! Ordered the defendant to pay the claimants costs even though they served the claim to an incorrect address! Surely an erroneous transposition and it should have been the claimant to pay the defendants costs!

    OP, did you pay the application fee for the set aside? did you pay the claimants costs, or did you just agree for the claimant to submit the set aside application with their own draft order?

    He has set aside the CCJ but left the claim live without the defendant being given an opportunity to defend. Hopefully, when the claimant goes back to the court by 14th March, whingeing that they have been unable to settle, he will order the defendant to submit a defence after the claimant resubmits the claim.

    As it is most likely DCB Legal, they will most likely put it into the "too much bother" folder and discontinue.

    Did they pay your £275 costs?

    If no, you'll have to email the Court to put right the error in the order IMMEDIATELY.

  • Hi, yes, the error was highlighted immediately, and the Claimant did pay the costs.  

  • I have requested assistance from the Small Claims Mediation service, although all the tel numbers listed for them on Government website, and their own website are ALL incorrect.  It is a joke and a seriously inept service provided by them throughout the whole process, the legal service is definitely geared towards the Claimants and not defendants! 

    I am hoping that by emailing the Small Claims Mediation service, I can halt the process and may ??? get some assistance regarding this matter.  It is extremely stressful and I wish the Government would stop letting these parking companies get away with charging extortionate fees, and taking people to court.
