Thanks everyone but I'm out of time as I've just received court papers including  response pack and Acknowledgement of service  from DCBLegal today.

I've read the NEWBIES THREAD so I can follow that the best I can and understand.

Do I still need to start a new thread for advice on my next steps now I've received
    The N1SDT, N9SDT, N9A (SDT), N9B (SDT) forms.

    Claimant is Vehicle control services

Please do not start another new thread about this incident.

What do you mean by 'out of time'?

What is the Issue Date on your Claim Form?

Can you please show us a picture of the Particulars of Claim - with all your personal detail hidden of course.

Have you filed an Acknowledgment of Service?
If so, upon what date did you do so?
Your MCOL Claim History will have the definitive answer to that.
  • 'out of time' to locate the landowner to cancel the PCN

Issue date of Claim Form is 19th Feb 2025

    POC attached

No AOS filed as I've only just r
received court documents today 21st Feb.

I will be defending all of the claim.

    Thanks for assisting me

With a Claim Issue Date of 19th February, you have until Monday 10th March 2025 to file an Acknowledgment of Service('AOS'), but there is nothing to be gained by delaying it.
To file an AOS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an AOS in a timely manner, you have until 4pm on Monday 24th March 2025 to file a Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the AOS guidance.
Don't miss the deadline for filing an AOS, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an AOS has been filed, the MCOL website should be treated as 'read only'.

In your opinion can the total amount be more if I were to lose?

What do judges award to these PPCs if they win a case?

I have fully conformed with the appeals process from the beginning and corresponded with the other side and therefore complying with the Civil Procedure Rules 1998 that DCBlegal outlined in one of their letters.

What percentage of claims are discontinued, regardless of facts and merit (or not) by DCB Legal?....is it quite common that cases go to the wire and the day following the mediation telephone call you get a letter iof discontinuance if you don't make an offer?

How much is this costing the claimant to take it to court even if they win surely it's not financially in their best interests?

     Are most DCB cases discontinued?

Perhaps the local council have a record of who pays the business rates on that property. A quick visit to their offices, or website, and obtain the info. for free
Person that pays the business rates isnt necessarily the owner. As a tenant in an industrial unit it was us that had to deal with business rates.
But this a Money Saving website and a Council enquiry might give the OP the answer for free, or point them in the right direction. Even a tenant might help since the owner's name is presumably in the public domain.

You'd already know that you'd pay  less than the claim if you lose, if you'd read the 2nd post of the NEWBIES thread. This is stated there. Please read that first.

    Are most DCB cases discontinued?
Yes ... in general .. but not always when it's VCS. Assume it'll go to a hearing.

You can always offer tuppence ha'penny at Mediation, which we assume you've read about because that's fully covered in the Template Defence thread.  This is easy to defend.

As well as reading the second post of the NEWBIES thread and the Template Defence thread, also search the forum for NEWEST results cor these keywords

    defence regarding prohibited consideration
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Breathing a sigh of relief Stage 1 of fighting back completed - AOS submitted 23/2/25

Thanks for the dropbox AOS guidance

Am I correct in using MCOL as read only now and to send my defence to ClaimResponses.CNBC@justice.gov.uk?

When it comes to completing my defence can I still use the MCOL defence link to fill in all the details and defence and then print off then sign and then rescan the document before emailing it to ClaimResponses.CNBC@justice.gov.uk as instructed?

I had hoped that the answer to the first question there was made clear in my earlier reply.
By following the guidance, you will have found the needed email addresses.

When it comes to completing my defence can I still use the MCOL defence link to fill in all the details and defence and then print off then sign and then rescan the document before emailing it to ClaimResponses.CNBC@justice.gov.uk as instructed?
I don't even understand your question.
What does "can I still use the MCOL defence link" actually mean?

My earlier post suggested that the MCOL webpages should be treated as 'read only' after an Acknowledgment of Service has been filed.

If I'm copying and pasting say Coupon-mad defence and adding my own would it be easier to choose defence on MCOL fill it all in and then not submit it but print the defence sign it, rescan and then email it to Claim responses.CNBC@justice.gov.uk but not submit it on MCOL
