    Yep.

That's common and as you saw, they don't even have a true witness or any evidence.

Make sure you take proof of your costs, such as travel, taking a day off work or a day's leave. Also try asking for hours spent on this farce at the standard court rate of £19 per hour.

Or higher if you take proof of your daily rate.

Ask the judge directly to order your costs even if he/she wants the case over. Cough and say "yes there is something else, judge"!

You get a right to costs where a party has acted unreasonably. I'm sure you get the picture!

Gladstones replied to my WS with their second WS, should I also reply to theirs myself or wait for the hearing?

Ignore it but at the start of the hearing raise two preliminary matters:

    1. The second WS adds nothing, was late and should be struck out, and

    2. The whole claim must be struck out, due to the woeful POC which failed to comply with Part 16. Authorities: CEL v Chan and CPMS v Akande.

Hey @Coupon-mad could you help me with the WS or point me in the right direction?

I decided that I should probably start on them and hope that the first case gets re allocated correctly as the second one is at my local court with a hearing in August.
Let us know how it goes.

And if you want to be part of the push to change things in future, it's very important that people like you tell the Government NOW that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.

b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND ENGINEERING A 'PAYMENT PLAN'.

c). Tell them about your experience and the fact you are coping with two claims (allocated in error to 2 different courts) because they didn't consolidate the 'debt' into one.

Responses are invited to the Consultation now:

Do it by August at the latest pleeease! We will discuss it on that thread.

You may wish to wait until after the first hearing as you may have more to say then.
