Have Smart Parking changed their tactics???
Comments
-
Yes, Gr1pr, i agree, will do. Thanks all for advice, just wanted to post out the new images so people are aware of Smart's new tactics running 2 appeal routes, one that the usual " i was not the driver" may not work ie SP appeal.
Do i have to put forward a driver as requested in the second para of section headed PCN INFORMATION on the back page ie is this a legal requirement???0 -
No.
But the wording on the back is POFA compliant.
The date deemed served isn't.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks, yes unfortunately thought the wording was possibly ok, could you explain why the dates aren't?? Yes never appeal as driver.Coupon-mad said:1 -
You can see for yourself. We'd rather people just read para 9 of Schedule 4 and see why. Far better that you research and get itPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OK, para 9 (5) relevant period of notice = 14 days, (6) second working day after the day on which it is posted/issued. Therefore date of contravention 15/1/25, issue date 28/1/25 plus 2 days (second working day after posting/issue) = 15 days in total making the notice invalid?? How does this sound Coupon Mad?? Many thanks
ps i appreciate the previous advice re land ownership and no contract, its just this route is intriguing me.1 -
Just log the normal appeal in the Newbies thread and come back to us if newded1

Yep, save the 14/15 days point for POPLA.
It will need spelling out because they have shown before that they cannot count to 14. An Assessor just looked at a calendar and added 14 days on (instead of counting: day one, day two, etc) as was admitted by the Lead Adjudicator when answering the complaint!PRIVATE 'PCN'?
