The issue is they are refusing to refund the £300 deposit.
Now I could have taken out the same phone with no deposit but higher monthly bill and they would not have been able to keep anything.
Im just confused about the distance selling regulations, I thought the cooling off period was 14 days. Its within that timeframe.
There is no damage to the phone at all so Im happy that they can examine it.
Im just really confused as I always thought the first 14 days you could change your mind.
Yes I would be looking to swap providers.

2. If you have was the device reset and removed from any accounts before return ?
3. was the device still in grade A condition, when you returned it i it;s original packaging and secured in a suitable outer bag /envelope/ box ?
4. has the network acknowledged the reciept of the returned device?
5. have the network confirmed the returned device was received in an suitable condition ?0 -
if it;s on a refresh deal there should be the option to 'pay off the device' and then cancel the contract as Refresh was the first product that re-invented decoupled deivce and airtime payments , although i gather they have gone back to rolling the payments up again as the clueless failed ot grasp this simple idealpau1777 said:

Part of the conditions for them accepting the contract cancellation was I needed to send the phone back within the first 14 days. No option to end the contract and buy the phone.
I tried to call them today I was on hold for 1 hour 20 minutes, then the phone cut out. I cant face being on the phone for another hour today or it just cutting out again.
I would not have gone with o2, it was my daughter who said she wanted to have the option to upgrade after 6 or 12 months.
You live you learn I guess, just dont want this to be a very expensive 3 days thats all!0
