Hi All,
Currently disputing a parking charge from Euro Parking Services for the above location. I read in the threads that a someone has already raised a thread about this location, but I cant seem to find it. Can someone point me in the right direction or share the link please?
In essences I need to complete my defence and currently researching if there have been other similar cases to mine.

Defence?
You have a Court claim form?
Show us that claim form, redacted of the FOUR THINGS everyone else does on claim threads. Read a dozen. All are the same.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Lovely. Easy stuff!
Same as all other Gladstones claim threads. Read a few (2024 only) and copy what they did. You will use the alternative hharry100 defence linked in the Template Defence itself.
Your facts will be at para 5 after the Chan transcripts.
You can also go the whole hog and add the CPMS v Akande transcript too or maybe the whole 'judgments' link posted by @Le_Kirk which has both of those cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yep. It's what we do every day.
But please please ... don't show us the entire Template Defence that I wrote and don't need to review!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

With a Claim Issue Date of 4th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 9th December 2024 to file a Defence.
That's nearly four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
You need to be aware that those Particulars of Claim are totally inadequate.Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.
This will be an easy win.2 -
thanks both, will get working on the defence shortly. I've been reading through the posts and just wanted something clarified. This comment from the template defence post "...Most claims do not even state the alleged breach. If yours doesn't state what the breach was, add the paragraphs and judgments seen in the defence by @hharry100 here:..." got me reading into my own claim letter and it states - "...parked in breach of the terms of parking stipulated on the signage..." I know it says breach but it doesn't actually say anything, just along the lines of please see the parking sign. My question is, is this a classic example of not explaining the breach as you mentioned? or am I reading too much into it and the breach has been explained?1

Let's make it simple:
Gladstones claims are currently ALWAYS cases for the hharry100 version of defence.
Read literally any 2024 Gladstones Claim thread if you want inspiration for your para 5.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My question is, is this a classic example of not explaining the breach as you mentioned?Absolutely. Chan applies. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
