  • I sent it to the email addresses that were available because I read in the sticky it has to be done via email to keep records. 

    Here is my appeal hope everything is good to send now  



    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.


    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.


    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.


    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.


    Double reds are only used for no-stopping zones which require 'repeater signs' at a prominent angle facing the traffic.  At this retail park there are no repeater signs facing the traffic and no offer of parking either.


    The problem with PPC adopting highway code equivalent signage is that the motorist will reasonably assume that restrictions are equivalent, unless signs are REALLY clear. As a reminder, the highway code provides thus:

    "Red Route stopping controls

    Red lines are used on some roads instead of yellow lines. The double and single red lines used on Red Routes indicate that stopping to park, load/unload or to board and alight from a vehicle (except for a licensed taxi or if you hold a Blue Badge) is prohibited."


    The vehicle in question was an Uber (the driver has a PCO licence) and was merely picking up a passenger, as your sneaky CCTV will have captured. That is allowed on red lines. Without any repeater signs facing oncoming traffic, this is not a 'red route' anyway.  Either way there was no breach. Want to take it to POPLA? Bring it on. You are in breach of the new joint Code.


    Furthermore, I demand the full video evidence showing the exact duration of the alleged “parking” and where the signage at the entrance clearly states the prohibition against stopping on red lines. This must be legible from a driver’s perspective while in motion. Failure to provide this will be seen as an admission of improper enforcement. Also the video must contain the back of the vehicle as the Wolverhampton taxi plate is displayed on the rear.

    You only send an appeal by email if the PCN says that.  Nothing in the NEWBIES thread says to go searching for random emails (and it doesn't say you must appeal by email).  Most firms use a standard appeals webpage.

    But what happened when you tried Plan A though because appeal is Plan B (only gets tried as a second tactic).

  • Ok so I will complain to the owner first. But who is the owner of capitol centre? Do I complain to Currys where I was parked outside or try to find who owns the retail park?
  • @Coupon-mad the parking fine has been cancelled thanks to you. The first complaint is what did it. I wrote to the owners of the land (British land) and within a few days got this. I owe you a coffee so send over PayPal or something for me to send a little gratitude.
