Please help ukpc on red lines

Hi I hope someone can help. Is it worth appealing or ignoring UKPC when I have been caught stopped on red lines waiting for a passenger as I work for uber. The letter says I was there for 1 min 23 seconds and there’s only one picture which could be anywhere. I’ve included the pictures that I’m able to view on their website.

I could have been driving very slowly avoiding a potential squirrel that was waiting to jump in front of the car. One pic doesn’t prove I was stopped.

Also if I am supposed to appeal. Which template should I use. Many thanks for looking.

Double red lines at a RETAIL PARK?

I guess this is in Preston?

Appeal stating that double reds are only used for no-stopping zones which require 'repeater signs' at a prominent angle facing the traffic.  At this retail park there are no repeater signs facing the traffic and no offer of parking either.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes you are right but is the Preston Capitol centre outside Currys to be exact.

If I add also that I want to see the video as the picture might be taken whilst the car was moving will there be of any benefit?

If this does work and I don’t have to pay the fine I would like to buy you a coffee for helping me as a token of my appreciation. You guys don’t need to take your time but do to help others like me.

Well the problem with PPC adopting highway code equivalent signage is that the consumer will assume that restrictions are equivalent unless signs are REALLY clear. They almost certainly won't be, as @Coupon-mad has already suggested.

I suspect the PPC is issuing PCNs willy nilly to all taxis and blue badge holders. As a reminder, the highway code provides thus (my emphasis).

    Red Route stopping controls

Red lines are used on some roads instead of yellow lines. The double and single red lines used on Red Routes indicate that stopping to park, load/unload or to board and alight from a vehicle (except for a licensed taxi or if you hold a Blue Badge) is prohibited.

As an Uber driver the o/p will have a PCO licence and essentially is permitted to stop for a pick up. A minute or so is not excessive.

Thanks. I will also include this in my appeal something along the lines of

“I work for Uber so A general question relating or not relating to this parking charge notice, if a taxi driver or Uber Driver needed to pick up a passenger and they’ve got a PCO license or private hire licence would they be allowed to pick up from these locations”

Whilst all the legal points are very valid, remember that this is UKPC and unless POPLA is persuaded by the arguments made above, this will end up as a DCB Legal issued claim and eventually be discontinued.

Those legal points will never be heard inside a courtroom.

You don't ask polite questions like that in an appeal to arrogant greed filled dimwits you tell them!
In any case this is UKPC who will ignore that and quote their own made up rules ignoring what ever you say, we are always right and the motorist is always wrong etc. etc., follow the process on here.

No need to worry it won't get anywhere in the end, but you are dealing with a private parking company whose coffers have been filled by scamming people in an unregulated industry, they have been twice suspended by the DVLA for falsifying evidence and they like most PPC's sail close to the wind in all they do.
They only make money by being intransigent, awkward, Muppets that try to wear you down with bluff and bluster, but like all bullies you have to face them, and you can with help from here.

Don't write your appeal as a question.

    Put what Johnersh said.

It's not a fine and nobody here ever pays UKPC.  Never.

How is this appeal. The last paragraph is my masterpiece let me know if I should include it

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

Double reds are only used for no-stopping zones which require 'repeater signs' at a prominent angle facing the traffic.  At this retail park there are no repeater signs facing the traffic and no offer of parking either.

The vehicle may work for Uber so generally stating which maybe relating or not relating to this parking charge notice, if a taxi driver or Uber Driver needed to pick up a passenger and they’ve got a PCO license or private hire licence they be allowed to pick up from these locations

    Red Route stopping controls

Red lines are used on some roads instead of yellow lines. The double and single red lines used on Red Routes indicate that stopping to park, load/unload or to board and alight from a vehicle (except for a licensed taxi or if you hold a Blue Badge) is prohibited.

Furthermore, I demand the full video evidence showing the exact duration of the alleged “parking” and where the signage at the entrance clearly states the prohibition against stopping on red lines. This must be legible from a driver’s perspective while in motion. Failure to provide this will be seen as an admission of improper enforcement.

By acknowledging this email, you are entering into a binding contract between UKPC and myself. You are required to fully respond to all statements made herein, or confirm the cancellation of the charge. You are given 28 days to reply. Failure to address any point or withholding information or missing the deadline will constitute a breach,  incurring a penalty of £3,000. Should such a breach occur, payment must be made in full within 30 days to the bank account of my choice, with a £10 discount if settled within 14 days.
